A. PUBLIC WORKS COMMENTS:
The proposed land use would classify Lucie, Brack, Mary and Carl Streets
as commercial streets. A dedication of right-of-way to 30 feet from
centerline would be required. As an alternative, petition the Planning
Commission and Board to abandon the right-of-way.
B. PUBLIC TRANSPORTATION ELEMENT:
The site is not located on a CATA bus route. It is located between Routes
16 (West 29th Street) and 14 (Asher Avenue).

C. PUBLIC NOTIFICATION:
All owners of property located within 200 feet of the site, all residents
located within 300 feet who could be identified, and the Curran Conway
Neighborhood Association were notified of the rezoning request.
D. LAND USE ELEMENT:
This request is located in the 1-630 Planning District. The Land Use Plan
shows Multi Family for this property. The applicant has applied for a C-4
zoning for an expansion to an existing C-4 Business.
A land use plan amendment for a change to Commercial is a separate
item on this agenda.
Citv Recoanized Neichborhood_Action Plan:
The applicant's property lies in the area covered by the Oak Forest
Neighborhood Action Plan. The Economic Development goal stated to
"create a healthy economic climate that encourages investment,
reinvestment, and diversity of employment opportunities." One of the
objectives is to "Develop programs to strengthen neighborhood
commercial locations".
E. STAFF ANALYSIS:
Kaufman Lumber Company is requesting to rezone the property along the
east side of Mary Street, between Lucie Avenue and Brack Street, from
"R-3" Single Family district and "R-5" Urban Residence district to "C-4"
Open Display district. The rezoning is requested to allow for the
expansion of the lumberyard facilities, specifically for the loading,
unloading and storage of lumber.
Currently, there are three (3) residential -type structures on the property.
The southernmost structure is utilized by Victory Outreach.
There is a vacant church building to the north across Lucie Avenue and a
contractor's maintenance yard on the 1-2 zoned property further north.
The existing Kaufman Lumber Company facilities are located across
Brack Street to the south. There is lumber storage (Kaufman) and two (2)
vacant, boarded -up single family structures on the 1-2 zoned property
immediately east. There is a single family structure and a multifamily
development on the property across Mary Street to the west.

The City's Future Land Use Plan designates this property as multifamily.
The applicant has filed a proposed land use plan amendment to
commercial, which is Item 7. on this agenda. The proposed land use plan
amendment has been expanded to include the vacant church property to
the north.
Staff is supportive of the requested rezoning to C-4. This site is located
along the Asher Avenue corridor which contains a wide range of
residential, commercial and industrial uses and zoning. The single family
residential uses in this general area are primarily located north of West
32nd Street and the 1-2 zoned property which contains the Baldwin and
Shell construction maintenance yard facility. Staff feels that rezoning this
property to C-4 will have no adverse impact on the adjacent properties or
this general area between Asher Avenue and West 32nd Street.
F. STAFF RECOMMENDATION:
Staff recommends approval of the requested C-4 zoning.
PLANNING COMMISSION ACTION: (SEPTEMBER 18, 2003)
The applicant was present. There were no objectors present. Staff presented
the item with a recommendation of approval.
The applicant offered no additional comments.
The Chairman placed the item before the Commission for inclusion within the
Consent Agenda for approval as recommended by staff. A motion to that effect
was made. The motion passed by a vote of 10 ayes, 0 nays and 1 absent. The
application was approved.
