Location: 15900 Arkansas Systems Drive Area: 16.343 acres Request: Rezone from 0-2 to 0-3 Purpose: Future Office Development Existing Use: One (1) single family residential structure SURROUNDING LAND USE AND ZONING North — Undeveloped property; zoned 0-2 South — Office development (across Arkansas Systems Drive); zoned O-2 East — Single Family residence and undeveloped (across Kirk Road); zoned MF -18 and 0-2 West — Office development; zoned 0-2 A. PUBLIC WORKS COMMENTS: 1. The proposed land use would classify Kirk Road on the Master Street Plan as a commercial street. Dedicate right-of-way to 30 feet from centerline. 2. A 20 feet radial dedication of right-of-way is required at the intersection of Kirk Road and Systems Drive. B. PUBLIC TRANSPORTATION ELEMENT: The site is not located on a CATA bus route. FILE NO.: Z-7478 C. PUBLIC NOTIFICATION: All property owners located within 200 feet of the site and all residents within 300 feet who could be identified were notified of the proposed rezoning. There was no established neighborhood association to notify. D. LAND USE ELEMENT: This request is located in the Chenal Planning District. The Land Use Plan shows Office for this property. The applicant has applied for 0-3 zoning for an office development. The proposed does not have a significant impact on the Land Use Plan, which would necessitate a Plan Amendment. Cily Recognized Neighborhood Action Plan: The property under review is not located in an area covered by a City of Little Rock recognized neighborhood action plan. E. STAFF ANALYSIS: Acxiom Corporation, owner of the 16.343 acre tract located at 15900 Arkansas Systems Drive (northwest corner of Arkansas Systems Drive and Kirk Road), is requesting to rezone the property from "0-2" Office and Institutional District to "O-3" General Office District. The rezoning is requested for the future development of offices and support facilities for Acxiom Corporation. There is currently and single family residence and accessory buildings within the south'/ of the property, with the north Y2 being undeveloped. There is undeveloped 0-2 zoned property immediately north of the site, with MF -18 zoned property further north along Rahling Road. There are existing office developments to the west and south across Arkansas Systems Drive. There is a single family residence west of the site (across Kirk Road), along with undeveloped MF -12 and 0-2 zoned property. The City's Future Land Use Plan designates this property as office. The requested 0-3 zoning does not require a change to the Land Use Plan. Staff does not support the requested rezoning to 0-3. Staff feels that the property should be developed under the site plan review standards for 0-2 zoning, as were the properties to the west and south along Arkansas Systems Drive and Technology Drive. According to the purpose and intent section for 0-3 zoning (Section 36-281(a) of the Zoning Ordinance): 2 FILE NO.: Z-7478 (Cont. "The 0-3 district is characterized by freestanding buildings and ancillary parking, and shall be limited to arterial street locations in developed areas of the city and other carefully selected areas where public utilities, community facilities and other public services are adequate to support general office development." The purpose and intent section for 0-2 zoning (Section 36-280(a) of the Zoning Ordinance) contains the following: "The 0-2 office and institutional district is established for a twofold purpose: To provide appropriate locations for well- designed office facilities on large tracts, generally not available in the built-up areas of the city, and to provide for unified orderly development of major cultural, educational, medical, governmental and religious facilities" "In order to support and enhance their benefit to the community, height and area, standards are designed to assure the harmonious integration of such development with surrounding neighborhoods. The 0-2 district may be applied to either existing developed areas to facilitate expansion of existing office and institutional uses or to undeveloped locations were such uses are also appropriate. Low intensity of land usage and park -like setting are primary characteristics of this district. Where office buildings higher than forty-five (45) feet are anticipated, greater setbacks are required in order to provide light and air to adjacent properties. Limited retail and service uses are permitted as accessories to the principal use." Staff feels that it would be more appropriate to develop this large acreage tract as per the 0-2 zoning regulations. Staff feels that development of the property under the 0-2 site plan review standards will assure compatibility with the adjacent office developments and undeveloped property. F. STAFF RECOMMENDATION: Staff recommends denial of the requested 0-3 zoning. 3 FILE NO.: Z-7478 Cont. PLANNING COMMISSION ACTION: (SEPTEMBER 18, 2003) The applicant was present. There were no objectors present. Staff noted that the applicant had requested to amend the application by adding the following conditions to the proposed rezoning to 0-3: Provide right-of-way dedication for Kirk Road to meet Master Street Plan Standards. 2. Restrict maximum building height to 45 feet. 3. Provide minimum building setback of 40 feet from existing property boundaries. 4. Limit signage to the maximums allowed for office uses. 5. Provide street buffers of 35 feet minimum on Arkansas Systems Drive and Kirk Road frontages. 6. Limit building area coverage to 40 percent of the property area. 7. Limit minimum lot sizes to two acres if property is subdivided at a future date. Staff recommended approval of the requested 0-3 zoning, subject to the conditions as offered by the applicant. The applicant offered no additional comments. The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as amended by the applicant and recommended by staff. A motion to that effect was made. The motion passed by a vote of 10 ayes, 0 nays and 1 absent.
