B. PUBLIC TRANSPORTATION ELEMENT:
The site is not located on a CATA bus route.
C. PUBLIC NOTIFICATION:
All property owners located within 200 feet of the site, all residents located
within 300 feet who could be identified, and the Heights Neighborhood
Association were notified of the proposed rezoning. The Heights
Neighborhood Association is in support of this zoning change.

D. LAND USE ELEMENT:
This request is located in the Heights Hillcrest Planning District. The Land
Use Plan shows Single Family for this property. The applicant has applied
for R-2 Single Family to recognize existing conditions.
The request does not require a change to the Land Use Plan.
CitV Recognized Neighborhood Action Plan:
The applicant's property lies in the area covered by the Heights
Neighborhood Action Plan that is a separate item on this agenda. The
Future Land Use Goal states to "Maintain Future Land Use as shown in
the Heights area". The objective states, "We do not support any zoning
changes that are in conflict with the Future Land Use Plan." This change
would bring the zoning into conformance with the Future Land Use Plan.
E. STAFF ANALYSIS:
This rezoning request is the first step in implementing the Heights
Neighborhood Action Plan. This property, and the property to the north
were both shown as C-3 General Commercial prior to 1992. It is believed
that these were shown as C-3 as part of a plan to provide small-scale
commercial areas scattered throughout the city. The northern property
was rezoned on January 21, 1992 by Ordinance # 16,147 and was
precipitated by attempting to obtain a building permit.
As part of the Neighborhood Action Plan process, the Staff reviews the
Land Use Plan and the Zoning map with the group working on the plan.
At that time, it was discovered that a residence was zoned C-3. The
group asked staff to contact the property owner and see if they wished to
rezone to R-2 Single Family to be consistent with the Future Land Use
Plan and the adjoining properties. Attached is a copy of the letter from the
owner.
F. STAFF RECOMMENDATION:
Staff recommends approval of the requested R-2 zoning to remove the
non -conforming status of this property.

PLANNING COMMISSION ACTION: (SEPTEMBER 18, 2003)
The item was placed on the consent agenda for approval. A motion was made
to approve the consent agenda and was approved with a vote of 10 ayes, 0 noes
and 1 absent.
