3 AN ORDINANCE TO ABANDON THE SIXTY (60)-FOOT WIDE EXCESS
4 COOPER ORBIT ROAD RIGHT-OF-WAY, LOCATED BETWEEN
5 PANTHER BRANCH DRIVE AND KANIS ROAD, IN THE CITY OF
6 LITTLE ROCK,ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS,the adjacent property owner requests to abandon the sixty(60)-foot wide excess Cooper
9 Orbit Road right-of-way, located between Panther Branch Drive and Kanis Road; and,
10 WHEREAS, on July 14, 2022, the Planning Commission reviewed and approved the abandonment
11 request as part of the Woodlands Valley Revised PRD(Z-9536-A); and,
12 WHEREAS, on August 16, 2022 the Board of Directors approved the Woodlands Valley Revised
13 PRD by Ordinance No.22,162; and
14 WHEREAS,the abandonment of this right-of-way will have no adverse impact on the public welfare
15 and safety.
16 WHEREAS, all of the public utility companies have reviewed and approved the requested right-of-
17 way abandonment;and,
18 WHEREAS,Central Arkansas Water has a twelve(12)-inch waterline in the area of the right-of-way
19 abandonment, and requested that the easement for the waterline be indicated on the plat. In addition,
20 Central Arkansas Water has requested that if the waterline was located outside the easement that a ten
21 (10)-foot easement be provided on each side of the waterline.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF LITTLE
23 ROCK,ARKANSAS:
24 Section 1. The City of Little Rock, hereby releases, vacates,and abandons the sixty foot wide excess
25 Cooper Orbit Road right-of-way, located between Panther Branch Drive and Kanis Road.
26 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate
27 Records of the Recorder of the Circuit Clerk in Ex Officio Recorder of Pulaski County,Arkansas.
28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part„gf,tJjs
