3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK. ORDINANCE NO.
4 22,205 (DECEMBER 6, 2022); TO DECLARE IT IMPRACTICAL AND
5 UNFEASIBLE TO BID; TO AUTHORIZE THE CITY MANAGER TO
6 AMEND THE CONTRACT WITH ARKANSAS MUNICIPAL LEAGUE
7 MUNICIPAL VEHICLE PROGRAM, AT A TOTAL REVISED COST OF
8 ONE MILLION SIXTY THOUSAND DOLLARS ($1,060,000.00), TO
9 ADMINISTER A SELF-INSURANCE PROGRAM FOR THE CITY OF
10 LITTLE ROCK'S MOTOR VEHICLE LIABILITY INSURANCE; AND
11 FOR OTHER PURPOSES.

13 WHEREAS,the City of Little Rock,Arkansas, is required by Arkansas State Law to totally self-insure,
14 or to have some kind of coverage available for motor vehicle accidents as set forth in Ark. Code Ann. §21-
15 9-303 (West 2008); and,
16 WHEREAS, the City participates in an insurance pool through the Arkansas Municipal League
17 Municipal Vehicle Program to administer a Self-insurance Program for the City of Little Rock's Motor
18 Vehicle Liability Insurance including comprehensive and collision for current vehicles; and,
19 WHEREAS, an amendment to Ordinance No. 22,205 (December 6, 2022) is requested to provide an
20 additional Seventy Thousand Dollars($70,000.00)coverage to provide for the additional vehicles added to
21 the City of Little Rock's vehicle inventory; and,
22 WHEREAS,the total cost of this purchase will increase from Nine Hundred Ninety Thousand Dollars
23 ($990,000.00)to One Million, Sixty Thousand Dollars($1,060.000.00);and,
24 WHEREAS, this extended purchase will provide Motor Vehicle Liability and/or Comprehensive and
25 Collision Insurance for the City's motor vehicles from January 1, 2023,to December 31,2023; and,
26 WHEREAS, the unique nature of this insurance pool makes it impractical and unfeasible for the City
27 to competitively select a similar carrier.
28 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
29 OF LITTLE ROCK,ARKANSAS:
30 Section 1.The City Manager is authorized to extend the current contract with the Arkansas Municipal
31 League Municipal Vehicle Program to administer a Self-insurance Program for the City of Little Rock's
32 Motor Vehicle Liability Insurance including comprehensive and collision for current vehicles, for a total
33 revised cost for this purchase of One Million Sixty Thousand Dollars($1,060,000.00).

1 Section 2. Because of the unique nature of the Arkansas Municipal League Municipal Vehicle Program
2 and the self-insurance pool,the Board of Directors finds that it is impractical and unfeasible to submit this
3 matter for competitive selection.
4 Section 3. Funds for this purchase are allocated in Fleet Services 2023 Operating Account No. 600020-
5 63610.
6 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
7 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
8 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
9 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
10 ordinance.
11 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
12 the provisions of this resolution, are hereby repealed to the extent of such inconsistency, including, but not
13 limited to Little Rock, Ark. Ordinance 22,205 (December 6,2022).
14 Section 7. Emergency Clause. The necessity to Motor Vehicle Liability and Comprehensive and
15 Collision Insurance for the City's Motor Vehicles is essential to the public health, safety, and welfare; an
16 emergency;therefore, is declared to exist and this ordinance shall be in full,force and effect from and after
17 the date of its passage.
