Dear Mr. Clark
The Little Rock Board of Directors adopted Ordinance No. 19,339 on June 21, 2005,
which established Jive in Java Short -form PCD. The approval allowed for the placement
of a temporary building on the site with the construction of a permanent building to begin
within 18 to 24 months. The Little Rock Planning Commission approved a time
extension request on August 16, 2007, to allow until June of 2008 for initiation or
completion of the permanent building proposed for this site.
Please allow this letter to serve as -notification that initiation of construction of the
permanent building must begin now or seek a revision to the previously approved PCD to
grant additional time for construction of the permanent building.

RE: Permanent Building

Dear Donna James
In reference to the above permanent building which we have been unable to build at this time.
We do appreciate the tolerance that the planning committee has shown toward our situation.
We realize we have not met the timelines that we had requested but we are still sincere in
making the business work at this location. We ask that the planning commission accept our
plans as defined below. As you know we have as well as other small businesses especially
startups as ourselves have endured and survived the worst economic downturn in the history
of our country.
We have during these times been able to survive and keep all of our taxes paid. Although we
have begun to see a slow positive trend we as owners have decided to make the following
plans in case the Coffee Shop business does not reach a sustainable business profit. Banks
have been unwilling to make a business loan for a permanent building under the current
economic conditions.
We are requesting the city planning division to approve our following time table and plans.
• We have contracted with a commercial real estate firm to list our property for sale. This
is for the property only and would result in the removing of the current business
building.
• We have a foot print design for a permanent building and project which by January of
2012 we will decide if the market has rebounded enough to support a permanent drive
through coffee shop.
• We are also reviewing other business types that could be better suited for the location
to produce a profit.
• The timeline for this would be the end of May 2012. At that time we will have executed
one of the above options or we will have removed the current structure and continue to
define a proper use for the property.
As a notation for consideration we have become well accepted by our business neighbors and
the community for the services we provide. We have not had any complaints concerning our
facilities and the conditions of which we keep it. We are also active in the Otter Creek Business
Owners Association. This association is promoting the local businesses and also exploring
opportunities to improve the Otter Creek Community.
Again we appreciate your tolerance in allowing us to maintain our business during these trying
economic times but also realize that you have certain standards and rules that you have to
follow to maintain the development of the Little Rock Community. We ask, that you will be
able to accommodate our plans outlined above through the end of May 2012

meeting date.

Clarks Corner Company doing business as Jive in Java drive through coffee (8101 Stagecoach Road)
shop came before you in August of 200E for approval of a junior version of our drive in coffee format.
We presented our plans to the commission with the junior shop and then a permanent building to be
constructed at a later date. On our presentation to the commission we detailed our plans and our
timeline projection for building a larger building with inside seating, patio, and double drive through
window system.
Our plans presented to you, based on our forecast of sales and the purchasing of the land, called for us
to begin and or finish construction for the larger building by June of 07.
Due to land issues for the purchase of the property we were not able to finalize the sale until
January of 2007. This was significantly behind our projected time line for acquiring the
property. This has delayed our ability to obtain financing for the final structure.
❖ Sales projections for this location are at the lower end of guidelines that we use to determine
the viability of a unit. Although the sales began at the lower end steady but slow growth shows
that as the area develops in housing and businesses so will our business.
❖ We have improved the location of the property with fill and a clean pad with partial pavement.
❖ Landscaping has exceeded the phase one of the planned site. Maintenance of the building
and property will be maintained to an attractive level.
We are asking the commission to extend to us until June of 2008 to initiate or complete our permanent
building. We request this in good faith, that our projections and growth will be adequate to allow the
financing of the larger building and move the junior building to a new location.
