B. Staff Analysis:
The applicant's justification is presented in
an attached letter.

Single family residential
The R-2 zoned property at 17 Chalamont Way is occupied by a one-story
brick and frame single family residence which is under construction, and
nearing completion. A two -car driveway from Chalamont Way will serve
as access. The applicant notes that an error occurred in the initial layout
of the single family residence. As a result, the structure extends
approximately seven (7) feet into the required rear yard setback, at the
structure's southeast corner.
Section 36-254(d)(3) of the City's Zoning Ordinance requires a minimum
rear yard setback of 25 feet. The southeast corner of the structure is
located approximately 18 feet from the rear property line, with the

southwest corner being set back 24.3 feet. Therefore, the applicant is
requesting a variance from this ordinance requirement.
Staff is supportive of the variance request. Staff feels that it was an
honest mistake that was made in the initial layout of the single family
residence which caused it to be located too close to the rear property line.
The survey which was used to obtain the building permit showed a rear
yard setback of approximately 26 feet at the structure's southeast corner.
Staff feels that the reduced rear yard setback will have no adverse impact
on the surrounding properties.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback variance,
as filed.
BOARD OF ADJUSTMENT: (NOVEMBER 25,2002)
The applicant was present. There were no objectors present. Staff presented
the item and a recommendation of approval.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as recommended by
staff by a vote of 4 ayes, 0 nays, and 1 absent.
