Lot 6, Block 6, Breckenridge First Addition Zoned: R-2 Variance Requested: A variance is requested from the fence provisions of Section 36-516 to allow for the construction of an 8 -foot tall privacy fence. Staff Analysis: The applicant's justification is presented in an attached letter. Single Family Residential Single Family Residential The R-2 zoned property at 24 Warwick Road is occupied by a one-story brick and frame single family.Tesidence. A driveway from Warwick Road serves as access to the property. There is a six (6) foot tall wood privacy fence which encloses the rear yard portion of the property. The applicant proposes to remove the six (6) foot tall fence and replace it with an eight (8) foot high wood privacy fence along both side and rear property lines. Section 36-516(e)(1) of the City's Zoning Ordinance allows a maximum fence height of six (6) feet in R-2 zoning. Therefore, the applicant is requesting a variance from this requirement. The applicant notes in the attached letter that the primary reason for the eight (8) foot fence height is for privacy, as there is an elevated deck on the rear of the house. Additionally, the houses to the southwest are at a slightly higher elevation than this property. October 28, 2002 Item No.: 5 (Cont. Staff is supportive of the variAnce as requested by the applicant. Staff feels that the request is very minor and will have no adverse impact on the surrounding properties. The adjacent property owners on both sides of this property and to the rear are in support of the eight (8) foot high fence. Letters of support from these property owners are attached. Staff will recommend that a finished side of the fence face these adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested fence height variance subject to the following conditions: 1. A building permit must be obtained. 2. A finished side of the fence must face the adjacent properties to the sides and rear. BOARD OF ADJUSTMENT- (OCTOBER 28, 2002) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff by a vote of 4 ayes, 0 nays and 1 absent. 2
