FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested PD -R. The Planning Commission voted to recommend denial of the PD -R request, by a vote of 5 ayes, 3 noes and 3 absent. CITIZEN The Planning Commission reviewed the proposed PD -R PARTICIPATION request at its December 19, 2002 meeting. There were objectors present. All property owners within 200 feet of the site, all residents within 300 feet, who could be identified, and the Parkway Place and the Gibraltar Heights/Point West/Timber Ridge Neighborhood Associations were notified of the Public Hearing. BACKGROUND At the September 19, 2002 Public Hearing of the Planning Commission, an application for the placement of eight units - of townhouse development was denied. The Commission also voted to allow the applicant to resubmit a BACKGROUND CONTINUED site plan at a lesser density without paying a filing fee should the applicant resubmit a plan within a three-month time period. The Commission also indicated the applicant would not be required to file a Land Use Plan amendment if the proposal was a lesser density. The applicant subsequently submitted a new application, which was reviewed by the Planning Commission at its December 19, 2002 meeting. The applicant proposes the placement of six (6) townhouse residential units on these three lots. There are three (3) units proposed to be located on the south property line (to back-up to Arthur Lane) and three (3) units to be located along the north property ' line. There will be a single concrete drive access point to the site from Atkins Road entering the center of the development. Units 2 and 5 are proposed at 1440 square feet with a 240 square foot garage. Units 1, 3, 4 and 6 are proposed at 1656 square feet with a 240 square foot garage. The applicant has indicated all units will be two-story. The units will consist of concrete block foundation, concrete slab on the first floor, wood framing, drywall interiors, composition shingles and brick and vinyl siding exteriors. The applicant has also indicated a six (6) foot wood fence along the north, south and west property lines and a wrought iron fence along the street side of Atkins Road. The development will utilize city garbage pick-up with residents taking their trash to the street side. The applicant has stated the units are for resale as individual homes and a Property Owners Association will be formed for maintenance and upkeep of the common areas. The applicant has indicated street improvements will be constructed to Arthur Lane and Atkins Road. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R-2 to PD -R: Lots 9, 10 and 11, Block 8, Gibralter Heights Addition, Now in the City of Little Rock, Pulaski County, Arkansas. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Threadgill Short -form PD -R is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36- 454 (e) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 5. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. This will attempt to change the zoning at 12800 Arthur Lane from single family to a PDR. The applicant wants to build six two-story town houses on 0.46 acre in a single family residential neighborhood. I live on the western property line of the proposed site. I am opposed to the request due to the following reasons: 1. The proposed density is too intense for 0.46 acre. 2. The current zoning and land use plan are single family residential. 3. This project is surrounded by single family residential homes and does not blend into the neighborhood. 4. The buildings and structures are not compatable with the neighborhood. 5. There is no buffer between the proposed site and office/commercial properties. 6. There is not an adequate buffer or separation between the buildings and residential property lines. 7. Proposed plan provides little or no space for out- door activities and guest parking. 8. The proposed project is not designed or oriented to look like other structures in the neighborhood. 9. These three lots are best suited for three single family residential homes. The developer has been requested to meet with our association on more than one occasion and he has not responded. I feel he has little interest in our neighborhood except financially. I am opposed to this application and trust that you as Commission members will support the majority of people in my neighborhood in keeping this proposed site R2 single family. Requests to rezone .48 acres and change the Land Use Plan were disapproved at the 9-19-02 meeting. The builder was asked to revise & resubmit his PD -R, without requesting a change in the Land Use Plan. Over 60 residents contacted in Gibralter Heights, Timber Ridge, & Point West subdivisions are petitioning you to OPPOSE the proposed rezoning R-2 to PD -R to build 6 townhouses for the following reasons: 1. The proposed multi -story townhouses will not blend with structures in this single - story neighborhood. 2. The proposed doubling of building density on .48 acres in the center of 9 -block Atkins Rd will look out of place surrounded by structures with double the space. 3. The proposed six (6) 2 -story townhouses will be packed into three (3) 50'x140' lots. The plan allows for an inadequate 6 feet between the townhouses and single -story residences to the west and north resulting in poor choices: view of a 94x20' wall and fence or view of roofs. The project needs further conception and design work to be a sustainable investment that integrates with the neighborhood. 4. What is the purpose of the front metal fence—no mention is made of an automatic gate? Wooden fences on 3 sides will not be consistent with existing homes either. The proposed plan provides little or no safe outdoor space for children, adults, and pets to play and talk because it is overly dense with building, car, and street improvement needs. 5. The patios are approximately 6'x12' so the tree canopies illustrated are unrealistic and deceptive because only potted plants would be feasible. The lush green character of the neighborhood is violated. 6. The proposed plan provides little space for vehicles of guests and services that will visit. The vehicles will have no choice but to park on residential streets Atkins Rd. and Arthur Ln. which are narrow, busy, and hilly. 7. Monthly rents on these units of 2 sizes will range $800--$1,000. Sold under a horizontal property regime, there would also be a monthly maintenance fee of about $120. None of these figures add up to affordable housing. Buying a home mortgage at a low interest rate would offer citizens better economy, privacy, and greenspace. 8. The applicant wants to sell the townhouses; however, he hasn't created a distinctive style or harmonious feel compared to successful townhomes elsewhere so prospects will want to rent them or sublease them for investment purposes. High turnover means high maintenance, high property insurance costs, wear and tear, and dissatisfaction. We calculate that the lots have adequate acreage, income-, and tax - producing capacity as single-family developments similar to the existing passive solar homes 1 block away. The Land Use Plan supports this assessment. Mr. Threadgill, a Hot Springs construction supplier, would do well to reconsider. Current residents are not opposed to Mr. Threadgill, renters, or mixed-use development. There are houses, apartments, and townhouses for rent in the area already, and developer De Haven has been approved to build 528 apartments 1 mile away. Setting a precedent for rezoning on small parcels of land to increase density will stimulate more quickly -built visual mis-fits of poor aesthetic quality. Our Association has offered several times to meet with Mr. Threadgill to resolve some of these issues. We have been excluded. We feel confident that if we could work together, we would come up with a plan that would satisfy the neighborhood and the builder. We believe he has not taken or had the time to develop an interest in blending with the neighborhood in the 3 months he has owned the land. Mr. Threadgill is in a hurry for short-term gain without weighing costs and design alternatives that could be considered through computer modeling. We are opposed to poor planning. We oppose this idea of obsolescent housing. Little Rock can offer affordable housing and sense of place to sustain the city and individuals' needs.
