NAME: Sonic Drive In — Conditional Use Permit
LOCATION: 2917 Cantrell Road
OWNER/APPLICANT: Baird, Inc./Irwin and Saviers
PROPOSAL: A conditional use permit is requested to allow for
construction, of a drive in restaurant on this C-3 zoned
property.
STAFF REPORT.
On August 2, 2002, the applicant submitted a request that this item be deferred to
allow for further review of the design. Staff recommends that the item be deferred to
the October 3, 2002 meeting.
PLANNING COMMISSION ACTION:
(AUGUST 22, 2002)
The applicant was not present. There were no objectors present. Staff informed the
Commission that, on August 2, 2002, the applicant had requested that the item be
deferred to the October 3, 2002 meeting. There was no further discussion.
The item was placed on the Consent Agenda and deferred to the October 3, 2002
meeting. The vote was 10 ayes, 0 noes, 0 absent and 1 open position.

On September 4, 2002, the applicant submitted a request that the item be deferred to
the November 14, 2002 meeting. Staff supports the request.

On October 8, 2002, the applicant submitted a request that this item be withdrawn.
Negotiations are ongoing and it is possible that a new application may be filed at a
later date.
STAFF RECOMMENDATION:
Staff recommends that the item be withdrawn, without prejudice.

Planning Staff Renuiremen#s:
1. Label building setbacks from all property lines; including canopies.
2. Buildings and canopies are assumed to be one-story.
3. Submit details and locations on all proposed signage; building, canopy and ground -mounted.
4. Indicate number of employees; total and by typical shift.
5. Submit days and hours of operation.
6. Submit details of site lighting; including parking lot and canopy lighting.
7. Show required dumpster screening.
8. Clearly label canopies.
9. Redesign site plan to provide required landscaping, buffers and to show new property line once right-of-way
dedication occurs.
10. Variances will be needed for reduced buffers on street side and rear.
11. A franchise and City Beautiful approval will likely be needed on the street side.
12. Possible front yard setback variance after right-of-way dedication.
13. Submit required cover letter.
14. Scale on site plan is incorrect.
Variance/Waivers: None requested; landscape, buffer and setback variances may be needed.
Public Works:
1. Cantrell Road is classified on the Master Street Plan as a principal arterial. Dedication of right-of-way to 55
feet from centerline will be required.
2. Provide design of street conforming to "MSP" (Master Street Plan). Construct one-half street improvement to
these streets including 5 -foot sidewalks with planned development. This will require extending third traffic
lane to driveway entrance and reconstructing ramp.
3. All driveways shall be concrete aprons per City Ordinance.
4. Appropriate handicap ramps will be required per current ADA standards.
5. Plans of all work in right-of-way shall be submitted for approval prior to start of work.
6. Obtain permits for improvements within State Highway right-of-way from AHTD, District VI.
7. Stormwater detention ordinance applies to this property.
8. Easements for proposed stormwater detention facilities are required.

Landsca e:
The proposed submittal does not allow for the minimum 9.75 wide street buffer required along Cantrell Road.
Additionally, the width of the proposed eastern perimeter landscaping strip drops below the minimum width of
6.7 feet. Since utility easements cannot count as land use buffer area, a portion of the southern perimeter fails to
provide the minimum land use buffer width of 6.7 feet.
These requirements take into account the reduction allowed within the designated mature area.
A six foot high opaque screen, either a wooden with its face side directed outward, a wall, or evergreen plantings
are required along the southern perimeter and that portion of the western perimeter that abuts residential
properties. Since the property to the south is at a much higher elevation screening may be deemed unnecessary.
An irrigation system to water landscaped areas will be required.
Other: Submit revised site plan and responses to staff issues no later than noon, Wednesday August 7, 2002.
