HomeMy WebLinkAboutZ-7267 Application 2October 2, 2002 Dear Commissioner: As residents, of the South End neighborhood in very close and distant proxidlity to Atty. Simmons Smith's properties at Cross and 31st, we are soliciting your favorable consideration this neighborhood's opposition to the issuance of a Special Use Permit for property at 1200 W. 31st Street. Our concerns for the liability of issuing such a Special Use Permit to Atty. Smith is based on his past and continuing actions as an absentee slum lord. Atty. Smith constantly shows disrespect to us through his failure to maintain his property, even when Code Enforcement has advised him to do so. (See Attachment 1, which demonstrates his failure to comply to such serious infractions as electrical matters.) For approximately ten years, Atty. Smith has selected tenants who either dealt drugs, sold drugs, or otherwise created havoc to the neighborhood. (Attachment 2 demonstrates an example of the kind of traffic brought to the neighborhood by residents of 1200 West 31st; and though not demonstrated here, the property at 1206 W. 31, 3016 and 3018 Cross Streets is similar. (Incidence reports from the Little Rock Police Department gives you some idea of their involvement.) Police and the Drug Enforcement Unit have responded to numerous calls to these properties, often making some arrests after the bust. Attachment 3 is an example of Atty. Smith's unwillingness to honor his commitment even to this Commission, when granted a postponement of the August 22, 2002, hearing; which we understood was requested to give him time to meet with the residents of the neighborhood. One month later, September 25, he had made no effort to schedule a meeting through the Alert Center, with any member of the Neighborhood Association or the Coalition. (This is a good example of his stalling tactics, which have been applicable to inspections of his properties and/or meeting the housing standards. As a result of our not having been contacted, the Coalition President extended to Atty Smith an invitation to meet with us at the Alert Center. Atty. Smith then distributed flyers inviting residents to a meeting on September 27, the date set by the Coalition. (Attachment 4, reflects Atty Smith's attempt to deceive both the commission and the residents) The outcome of the meeting was less than fruitful. Residents present were all left with the impression that Atty Smith only "snubbed" his nose at us. In essence, he indicated that he is a business man. He stated that as a business man profit is his bottom line and continuing to rent this property was too costly. He stated that after each tenant it was necessary to do repairs to the property. Of course, because we live lin the area, have such great concern for the properties, the tenants to whom he has rented the property and the agony we have endured over the past, approximately ten years, we were aware of his untruthfulness regarding expenditures or any other maintenance efforts. Further, Atty Smith indicated that he owns property all over the South end and other areas of the City; and in essence, he implied that he could do he wanted to do with his property. On about September 25, 2002, some workers began installing a roof at 1200 W. 31st Street. This was the first improvement done to this property in approximately ten years. On Friday, September 27, 2002, some men began power washing on this house, which we presumed was preparation for painting; however, to date October 2, the painting has not begun. The attached photos were taken on August 26, 2002. These photos reflect the the appearance of Atty Smith's property 99% of the time. It just seems a given that if Atty Smith has refused to maintain property for family use, there is no expectation that he will maintain property occupied by people who are in recovery. Mr. Smith's slum property is not suitable for people who are desirous of making a home, rather it is a good drop off place for people who are indulging or plan to indulge in illegal operations. As an example, people have been observed moving in with no furniture, only bed rolls; with cadillac cars for transportation. All of this was reported to the Alert Center and or LRPD. We believe that most, if not all, of Atty Smith's tenants are those with whom he comes in contact in his practice (upon release from jail or represented in illegal activities; thus be believe Atty Smith is fully aware of the type people to whom he rents. Numerous drug arrests have been made here. The most recent left the property vacant until Mr. Deno Davis moved men in who were in recovery. We cannot be certain, but just coincidentally, during the few weeks of their occupancy, residents of the 2900 and 3000 blocks on Cross Street experienced four break ins, which were the first for this part of the neighborhood in the past ten years. At this time, during a meeting at the Alert renter this was addressed. Information was brought to the meeting that information from the Zoning was "four unrelated persons could occupy a house as a family and no special permits were necessary". However, a young male resident of the neighborhood informed us that there were six men living there, three sets of bunk beds. Over the years, we have been able to negate with Laidlaw Bus Company, which services Little Rock School District, for location of bus stops we considered safe. This has resulted in a stop at the corner of 31st and Cross Streets this year and we certainly could not represent it as safe if the occupancies at that corner are transient. Our neighborhood has suffered greatly'frorn the tornado; however, recovery is in progress and the City, as well as residents, absentee landlords, and others with vested interests are making tremendous investments to assure complete recovery and continued growth. But efforts and commitments will be impeded if Atty Smith is granted such a permit. Conversations with persons who have experienced the kind of houses Atty Smith plans have shared with us that drugs seem to gravitate to there, as though the pushers are just waiting. Others say, contacts are made from the prison for location to these houses and often come with limited or no resources, which creates an indebtedness to the owner that are very difficult to settle. As an example, we have been told that these houses are unsupervised other than be a resident but observed by owners from time to time. The population is very transient, thus disallowing neighbors to become familiar with who should be legitimately in the area.
