ORDINANCE NO. 18,691
AN ORDINANCE WAIVING THE PROVISIONS OF SECTION
36-342.1 (C)(11) OF THE CODE OF ORDINANCES OF
THE CITY OF LITTLE ROCK, ARKANSAS TO PERMIT A
GROUND -MOUNTED SIGN TO BE INSTALLED ON THE
URBAN USE ZONED PROPERTY LOCATED AT 200 WEST
CAPITOL AVENUE IN THE CITY OF LITTLE ROCK,
ARKANSAS•' AND FOR OTHER PURPOSES.
WHEREAS, on March 7, 2000, the Board of Directors of the
City of Little Rock, Arkansas passed Ordinance No. 18,228 which
created a zoning district titled "UU" Urban Use District and
which also rezoned the urban core of downtown Little Rock from
Various Zoning Districts to "UU" Urban Use, and
WHEREAS, Section 36-342.1 (c)(11) of the Urban Use District
Development Criteria prohibits pole and monument signs on "UU"
Urban Use zoned properties, and
WHEREAS, Presidio Management, owner of the Bank of America
Building, desires to install a ground -mounted sign on its "UU"
Urban Use zoned property located at 200 West Capitol Avenue, and
WHEREAS, the Board of Directors of the City of Little Rock
has determined that request to be appropriate.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The provisions of Section 36-342.1 (c)(11) of
the Code of Ordinances of the City of Little Rock, Arkansas are
hereby waived to permit a ground -mounted sign to be installed on
the "UU" Urban Use zoned property located at 200 West Capitol
Avenue, Little Rock, Arkansas.
Subsection a. The sign is to be located at the western
edge of the westernmost planter located along the Capitol Avenue
frontage as indicated on the attached plan labeled Attachment
"Af.
Subsection b. The sign is to be located within the planter
and is not to exceed 5 feet 4 inches in height above the planter
and is not to exceed 42 square feet in area (3 feet 5 inches by
12 feet) .
SECTION 2. That the Ordinance shall take effect and be in
full force 30 days after the date of its passage and approval.
SECTION 3. Severability. In the event any title, section,
paragraph, item, sentence, clause, phrase, or word of this
ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not
affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared to
adjudged invalid or unconstitutional was not originally a part
of the ordinance.
SECTION 4. Repealer. All laws, ordinances, resolutions,
or parts of the same, that are inconsistent with the provisions
of this ordinance are hereby repealed to the extent of such
inconsistency.

SYNOPSIS
The applicant, on behalf of Presidio Management, owner of the
Bank of America Building located at 200 W. Capitol Avenue, is
requesting a waiver of the provisions of Section 36-342.1 (c)(11)
to permit a ground -mounted (monument) sign to be installed on
that UU, Urban Use, zoned property.

RECOMMENDATION
Staff recommends denial of the waiver request.

This waiver request is to be heard directly by the Board of

notified the Downtown Neighborhood Association of this request.
BACKGROUND
The Bank of America Building, formerly the Worthen Bank
Building, is located on the UU, Urban Use, zoned property at
200 West Capitol Avenue. A prospective tenant, Webster
University, is requesting that a ground -mounted (monument)
sign be erected in front of the building, on the West Capitol
Avenue frontage. The sign will measure 6 feet in height by
10.5 feet, including the precast concrete frame. The sign is
proposed to be placed in line with several planters that are
located in front of the building, adjacent to West Capitol
Avenue.
BACKGROUND
CONTINUED
On March 7, 2000, the Board of Directors passed Ordinance
No. 18,228 which created the Urban Use zoning classification
and also rezoned the urban core of downtown Little Rock to
UU, Urban Use district. The ordinance had a provision
whereby it would become effective on September 7, 2000. The
Urban Use district development criteria include provisions
designed to help create a compact, dense, distinguishable core
area. Section 36-342.1 (c)[11) of the development criteria
states:
"Off premise, pole and monument signs are not
allowed; otherwise, permitted signs shall be as in
Section 36-553, signs permitted in institutional and
office zones of this chapter."
The Urban Use district area regulations include a "build -to -
line" requiring new buildings to be constructed at the front
property line. The rationale behind not permitting ground -
mounted signs is that there should, ideally, be no room between
the building and the property line to place such as sign. In this
instance, there is an existing building that has an adequate front
yard large enough to allow for placement of a ground -mounted
sign.
Even so, staff does not believe it is appropriate to grant this
proposed waiver. Capitol Avenue is identified within the
Urban Use District as a "primary street." The corridors study,
part of the Downtown Framework for the Future, adopted by
the Board of Directors on December 7, 1999, identifies Capitol
Avenue as the State's principal ceremonial street. Anchored on
the west by the State Capitol and connecting to the area of the
Presidential Library District on the east, the corridor is planned
to include small parks, wide sidewalks, landscaping and public
art focusing on civic monuments. This segment of Capitol
Avenue contains the highest concentration of high-rise
buildings in the state and has well-defined street space and a
high quality pedestrian environment. Within the densely
developed section of Capitol Avenue, from Main Street west to
Chester Avenue, there are only 5 ground -mounted signs. One
of these will be removed when the Federal Court building is
expanded.
This proposed sign, which identifies one tenant within a high-
rise office building, clearly violates the spirit and purpose of the
Urban Use District and the Downtown Framework for the
Future.

Dear Dana,
Per our conversation today, I am hereby requesting a sign waiver, on
behalf of our client, Presidio Management, to install a ground mounted
(monument) sign on the Capitol Avenue side of the Bank of America Building
(see attached Site Plan).
realize that this property is designated as "UU" zoning, and within such
zoning districts ground mounted signs are not allowed. However, the building
was constructed in 1967, and has approximately 35 feet of landscape and
sidewalk area between the front of the building and the public right-of-way.
Within this space there are several large planters, seating areas and flag poles.
We propose to put this sign on the bank's property, as a means of identifying
WEBSTER UNIVERSITY, which would relocate to the building.
It is my understanding that this request would go directly to the City Board,
where at least two similar requests for signage downtown have been approved.

Dear Ms. Welch -Blair:
Presidio Management, owner of the Bank of America building located at 200 West
Capitol Avenue, has requested a waiver of Section 36-342.1 (c)(11) of the Code of
Ordinances to permit installation of a ground -mounted sign. The property is zoned "UU"
Urban Use District which prohibits ground -mounted signs. A drawing of the proposed
sign is attached for your information.
The waiver request will be heard by the Board of Directors at their June 18, 2002
meeting. The meeting is scheduled to begin at 6:00 p.m. and will be held in the Board
Chambers located on the 2nd floor of City Hall at 500 W. Markham Street.
This notice is being sent to advise you of the waiver request.
