SHORT -FORM POD (Z -7213-A) LOCATED AT 17005
CANTRELL ROAD IN THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING MAP
OF THE CITY OF LITTLE ROCK; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from PD -0 to POD:
Part of the SW 1/4 SW V4, Section 13, T -2-N, R -14-W, Pulaski County,
Arkansas, described as follows: Commence at the Southwest corner of the
said SW '/4 SW z/4, thence East, along the South line of said SW '/4 SW 1/4,
49 feet; thence N 27' E, 97.03 feet to the point of beginning; thence
continue N 27° E, 478.91 feet to the right-of-way of AR State Highway

Berg Company Short -form POD is conditioned upon obtaining a final plan approval
within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of
Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 5. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

SYNOPSIS
The applicant proposes to rezone the site from PD -O to
POD to allow multiple uses to locate on the site.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the requested rezoning to
POD. The Planning Commission voted to recommend
approval of the requested rezoning, as recommended by
Staff, by a vote of 10 ayes, 0 noes and 1 absent.
CITIZEN
The Planning Commission reviewed the proposed POD
PARTICIPATION
request at its May 1, 2003 meeting. There were no
objectors present. All property owners within 200 feet of
the site, all residents within 300 feet, who could be
identified and the Aberdeen Court Property Owners
Association were notified of the Public Hearing.
BACKGROUND
Ordinance No. 18,693 dated June 4, 2002 rezoned the site
from R-2, Single-family to PD -0 to allow the applicant to
convert an existing single-family house into an office to be
used as an insurance sales company. The site is located in
the Highway 10 Design Overlay District.
The southern -most area contained a garage (which remains)
and two manufactured homes which were removed as a part
of the development.
BACKGROUND The applicant proposed 7 parking spaces in the front of the
CONTINUED building, adjacent to Highway 10. The applicant proposed a
25 -foot landscaped area in the front yard with a single -ground
mounted sign.
The applicant proposes to revise the previously approved PD-
T to POD to allow more than one user or a combination of
users to locate on the site. The proposed uses include;
general or professional office uses, a travel agency, a
photography studio or a massage therapist.
As indicated on the proposed site plan, there are a total of
seven parking spaces located on the site. The applicant is not
requesting any additional signage or any change in the hours
of operation.
Otherwise, to Staff's knowledge, there are no outstanding
issues associated with the proposed request. Please see the
attached Planning Commission minute record and site plan
for the applicant's specific development proposal and the
staff analysis and recommendation.

Dear Sir:
Last year, 2001, Mike Berg Company purchased the resident at 17005 Cantrell
Road and requested a zoning change from residential to commercial. This property is
Located between two family residents. I was informed by the Department of planning and
Development that a privacy fence would be place on either side of the Mike Berg
property once the rezoning was approved. As of this date this fence has not been
Constructed on either side of this property.
Since the request is to change the zoning of this property from PD -0 single use
to POD to allow additional uses to locate on the site such as general and professional
office use such as, Camera Shop, Photography Studio and a MASSAGE THERAPIST )
Additional customers and longer hours of operation, which may be an option, will
Create more traffic next door.
The only privacy between my property and the Mike Berg property is
A privet hedge which provide's very little privacy and fails to block out any noise.
If the Planning Commission will instruct Mr Berg to have a privacy fence between the
Residents we will agree to the zoning change.
