(Z-9817) Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION BACKGROUND Action Required � Ordinance Resolution Approval Information Report Approved By Bruce Moore City Manager The owner of the 6.55 acres of property located along the west side of Jonesboro Drive, between 1-630 and West 12th Street is requesting that the property be reclassified from "R-3" and "0-3" to "PR". I None Approval of the Ordinance. The applicant proposes to rezone a total of approximately 6.55 acres located along the west side of Jonesboro Drive, between I-630 and West 12th Street, from R-3 and 0-3 to "PR" Park and Recreation District for future parks development. The property is comprised of the following platted lots: • All of Block 7, Cunningham's Addition • All of Block 10, Cunningham's Addition • All of Block 23, Cunningham's Addition • Lots 4 thru 8, Block 26, Cunningham's Addition BACKGROUND CONTINUED The property is currently undeveloped and partially tree covered, with varying degrees of slope. There is a mixture of residential, parks, office and commercial uses and zoning in this general area along West 12th Street and I-630. The City's Future Land Use Plan designates this property as "RL" Residential Low Density and "PK/OS" Park/Open Space. The proposed PR zoning will not require an amendment to the future land use plan. On September 14, 2023, the Planning Commission voted 9 ayes, 0 noes, 0 absent and 2 open positions, as part of the Consent Agenda, to approve the PR rezoning. There were no objectors present. All owners of property located within 300 feet of the site and all neighborhood associations registered with The City of Little Rock were notified of the public hearing. AN ORDINANCE RECLASSIFYING PROPERTY LOCATED IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. Section 1. That the zone classification of the following property be and is hereby changed as indicated: Z-9817 — DESCRIBED AS ALL OF BLOCKS 7, 10, 23, & LOTS 4, 5, 6, 7, & 8 OF BLOCK 26, ALL IN CUNNINGHAM'S ADDITION, CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS: From "R-3" Single Family District and "0-3" General Office District to "PR" Park and Recreation District (west side of Jonesboro Drive, between I-630 and West 1211 Street). Section 2. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 3. That the Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
