STAFF REPORT
A. Public Works Issues:

B. Staff Analysis:
The R-2 zoned property at 2604 N. Fillmore is occupied
by a one-story brick and frame single family residence.
The existing residential structure sits approximately
44 feet back from the front property line and conforms
to all of the minimum required building setbacks, with
the exception of the north side yard setback, which is
nonconforming. The existing house is located 6'-4"
from the north (side) property line. The City's Zoning
Ordinance would require a minimum setback of 7'-6111
based on the 75 foot lot width. The property is
located in an area of R-2 zoning, with all of the
surrounding uses being single family residential.

The applicant proposes to construct a room/garage
addition to the north side of the existing single
family structure. The proposed addition will maintain
the 6'-4" setback from the north property line to the
exterior wall, with the north wall of the building
being extended from 22'-1" to 66'-311. As noted in the
previous paragraph, the minimum side yard setback for
this property is 7.5 feet (Section 36-254(d)(2) of the
City's Zoning Ordinance). Therefore, the applicant is
requesting a variance for a reduced side yard setback
for the proposed building addition.
Staff is supportive of the requested variance. Staff,
feels that the proposed side yard setback variance is
very minimal in nature, as the proposed setback is
within five (5) inches of qualifying for an
administrative staff approval. A number of the single
family residences in this general area are located on
50 foot wide lots and have side yard setbacks which are
five (5) feet or less. Therefore, the proposed 61-411
setback for this proposed building addition will not be
out of character with the general area, or have a
negative effect on the adjacent properties.
C. Staff Recommendation:
Staff recommends approval of the requested side yard
setback variance, as filed.

The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff by a vote of 5 ayes and 0 nays.
