STAFF REPORT
A. Public Works Issues:

B. Staff Analysis:
The R-3 zoned property at 200 Thayer Street is occupied
by a two-story brick and frame single family residence
and a one-story brick and frame accessory building.
There are single family residences located to the south
and west, with an apartment building just further west.
There are also single family residences to the north
across Grove Circle and to the east across Thayer
Street.

The applicant proposes to construct an 18 foot by 22
foot accessory building (one story) near the rear
property line. The proposed accessory building will be
used as a garage and for storage. The proposed
building conforms to the required setbacks for an
accessory building, but occupies more than 30 percent
of the required rear yard (rear 25 feet of the lot) .
Section 36-156(a)(2)c. of the City's Zoning Ordinance
states that accessory buildings may not occupy more
than 30 percent of the required rear yard of a single
family lot.
For this particular lot, 30 percent of the required
rear yard would be 270 square feet. The accessory
building proposed by the applicant is 396 square feet
in area, with approximately 385 square feet being
located within the required rear yard area.
Staff is supportive of the requested variance. Given
the irregular pie -shape of the lot, the required rear
yard is only approximately 900 square feet in size.
The proposed garage occupies approximately 42.8 percent
of this area. Based on the small size of the required
rear yard and the fact that the applicant wishes to
locate the accessory building where it can be easily
accessed from the alley to the west, staff feels that
the request is reasonable. Staff does not believe that
the requested variance will have a negative impact on
the adjacent properties or the general area. ,
C. Staff Recommendation:
Staff recommends approval of the requested variance to
allow the accessory building to occupy more than 30
percent of the required rear yard, as filed.
