deposes and states
That I am the owner of the property located at 420 East 9rh Street, Little Rock, AR 72202 ,
more particularly descried as:
Original City of Little Rock, Block 60, East 82' of Lot 7
I, hereby agree to the following stipulations for the conversion of the referenced dwelling unit
being allowed to be converted to storage:
This dwelling unit will no longer be used for living purposes.
2. This structure will not be used for any purpose or in a manner that violates any
Zoning, Premise or Housing Codes of the City of Little Rock or requirements of the
MacArthur Park Historical District.
3. 1, hereby agree to remove all plumbing fixtures. (If approved by the Code
Enforcement Officer, based on my intended use, I may be allowed to keep a lavatory
and stool which must be in good repair and installed in accordance with applicable
codes.)
4. All electrical wiring will be in good repair and properly installed. if this dwelling unit
has gas service, all piping must be in good repair and installed in accordance with
applicable codes.
5, If at any time I wish to convert this unit back to living quarters, I will notify the
Department of Housing and Neighborhood Programs and will bring this unit into full
compliance with the Housing Code of the City of Little Rock prior to occupancy.
6, 1 also agree, in order to upgrade the appearance and stability of this unit, to do all
needed repairs and painting of the unit's exterior prior to converting to storage use.
7. 1 also agree to maintain the appearance and stability of this unit in a manner
acceptable to the City of Little Rock.
8. 1 further understand that if I allow this dwelling unit to be occupied without prior
approval from the Department of Housing and Neighborhood Programs a citation or
warrant may be issued for my appearance in Little Rock District Court.
9. 1 will allow inspections of this storage unit to insure it is maintained in a safe manner
that will not threaten the health, safety and welfare of the occupants of any attached
unit(s).
10. 1 will not store any flammable materials and will maintain this unit free of improperly
stored combustible materials.
U. I understand that if this unit is not repaired to meet code by January 8, 2006 that this
unit will not ever to be used as a dwelling unit as it will lose it's nonconforming use
per the rthur Park Historical District.

That I am the owner of the property located at 420 East Ninth Street, more particularly descried as:

That I hereby certify that all window air conditioner units currently in place will be removed from this
structure within seven (7) days to be in compliance with the Macarthur Park Historic District Design
Review Guidelines.
I further certify that I will not install air conditioning units on the property visible from the street or
permit any occupant of the structure and/or dwelling to install an air conditioning unit visible from the street
without first obtaining a Certificate of Appropriateness from the Little Rock Historic District Commission
through the proper procedures. I also agree to allow inspection of this property at all reasonable times.
I further understand that I will notify future lessees that the property lies within the Macarthur Park
Historic District and any air conditioners visible from the street must be granted a Certificate of
Appropriateness from the Little Rock Historic District Commission before installation occurs.

Dear Mr. Gray:
This letter is to inform you that, as owner of the apartments located at 420 East Ninth
Street, you are considered to be in violation of Little Rock's historic district ordinance for
failure to obtain a Certificate of Appropriateness prior to installation of air conditioner
units and for failure to remove those units from your rental property as promised in your
affidavit dated December 28, 2004. Because your rental property is located within the
MacArthur Park Historic District, any changes in the building's exterior design or
materials must receive prior approval by the Historic District Commission.
If you do not contact me immediately upon receipt of this letter, this matter will be
referred to the Office of the City Attorney. To avoid legal action, you must either remove
the air conditioner units immediately or apply for a Certificate of Appropriateness and
meet all requirements of notice and hearing before the Historic District Commission.
Since your Certificate of Occupancy was contingent on your promise to remove the air
conditioner units, a copy of this letter is being forwarded to Building Codes Manager
Charles Givens to place him on notice that the Certificate of Occupancy should not be
issued.
You are urged to contact this office as soon as possible to be informed of what is
required.

This is in regards to the sign for the Macarthur heights Apartments at 420 East Ninth Street. The Sign
is located within the Macarthur Park Historic District. All signs are suppose to be reviewed by the
Historic District Commission in order to protect the integrity of the district. On December 14, 2004
Brian Gray, represent PDIC Investments applied for a four foot tall by three foot wide non illuminated
sign for his seven unit apartment complex. The sign permit was granted (permit #23899G) and the fee
of $50.00 was collected. The applicant did not apply for a Certificate of Appropriateness as required in
the Historic District. Since that time Historic District Staff has received several complaints from area
property owners about the signage prompting us to look into the matter further. Upon further
investigation Historic Commission Staff visited the site and noted that the sign was indeed in place.
The sign that is now on the property is one that would have most likely NOT been approved by the
Commission because of its lettering and design.
The Historic District Staff is wondering what we can do to remedy this situation. Can his permit be
revoked or do they get to keep the sign? Please let us know shortly.
