HomeMy WebLinkAboutZ-7072 ApplicationGARY EUBANKS & associarEs I SSN)W ORDINANCE NO. 18,522 AN ORDINANCE WAIVING THE PROVISIONS OF SECTION 36-342.1 (C)(11) OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS TO PERMIT A GROUND -MOUNTED SIGN TO BE INSTALLED ON THE ,URBAN USE ZONED PROPERTY LOCATED AT 708 WEST 2"D STREET IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. WHEREAS, on March 7, 2000, the Board of Directors of the City of Little Rock, Arkansas passed Ordinance No. 18,-228 which created a new zoning district titled "UU" Urban Use District and which also rezoned the urban core of downtown Little Rock from Various Zoning Districts to "UU" Urban Use, and WHEREAS, Section 36-342.1 (c)(11) of the Urban Use District Development Criteria prohibits pole and monument signs on "UU" Urban Use zoned properties, and WHEREAS, the law firm of Gary Eubanks and Associates desires to install a ground -mounted sign on its "UU" Urban Use zoned property located at 708 West 2nd Street, and WHEREAS, the Board of Directors of the City of Little Rock has determined that request to be appropriate. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The provisions of Section 36-342.1 (c)(11) of the Code of Ordinances of the City of Little Rock, Arkansas are hereby waived to permit a ground -mounted sign to be installed on the "UU" Urban Use zoned property located at 708 West 2nd Street, Little Rock, Arkansas. SECTION 2. That the Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared to adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION BACKGROUND Action Required Ordinance Resolution Approval Information Report Submitted By Cy Carney City Manager Gary EE Ubanks and Associates Law Firm is requesting a waiver of Section 36-342.1 (c)(11) to permit placement of a ground -mounted sign on the UU, Urban Use, zoned property at 708 West 2nd Street. None Staff recommends denial of the waiver request, as filed. This waiver request is to be heard directly by the Board of Directors. There is no other public hearing. There is no provision for notification associated with this type of request. Staff has notified the Downtown Neighborhood Association of the request. The law firm of Gary Eubanks and Associates is requesting that the provisions of Section 36-342.1 (c)(11) be waived to permit installation of a ground -mounted sign on the UU Urban Use zoned property located at 708 West 2nd Street. On March 7, 2000, the Board of Directors passed Ordinance No. 18,228 which created the new Urban Use zoning classification and also rezoned the urban core of downtown Little Rock to UU, Urban Use district. The ordinance had a provision whereby it would become effective on September 7, 2000. The Urban Use district development criteria include provisions designed to help create a compact, dense, distinguishable core area. Section 36- 342.1 (c)(11) of the development criteria states: "Off premise, pole and monument signs are not allowed; otherwise, permitted signs shall be as in Section 36-553, signs permitted in institutional and office zones of this chapter." BACKGROUND Eubanks and Associates now proposes to install a 13'9" ground - CONTINUED mounted sign nt the Gaines Street and West 2nd Street corner of their property. The sign consists of an analog clock and identification panel mounted on 9' tall pedestal. The Urban Use district area regulations include a "build -to line" requiring new buildings to be constructed at the front property line. The rationale behind not permitting ground -mounted signs is that there should, ideally, be no room between the building and the property line to place such a sign. In this instance, there is an existing building that has an adequate front yard large enough to allow for placement of a ground -mounted sign. Even so, staff believes the proposed sign does not meet the spirit and intent of the UU District. Clearly, ground -mounted signs are not permitted at all. Otherwise, signs are to conform to the standards for the office and institutional zoned of the City. Within the office zones, ground -mounted signs are not to exceed 6 feet in height and 64 square feet in area. If a sign meeting that standard was proposed, staff would be supportive of a waiver for this site. Since ground -mounted signs are not permitted in the UU district, the Board of Adjustment cannot grant a variance to permit the requested sign. Only the Board of Directors may waive the Ordinance provisions to allow the sign. vi6 Area Zoning 708 WEST 2ND. We are requesting a variance from the city code that restricts pole signs in the Little Rock Metro area. Trees just in front of the building block the view of the existing wall sign, you are able to read the sign within a 30 ft. area. There are other (ground mounted/pole) signs within a 4 block area that relate to the type sign we are requesting. We realize the importance of aesthetics, color and quality for this area and hope that the board will approve our request based upon our presentation. We appreciate your consideration. The property is zoned "UU Urban Use District which prohibits ground -mounted signs. A drawing of the proposed sign is attached for your information. The waiver request will be heard by the Board of Directors at their July 3, 2001 meeting. The meeting is scheduled to begin at 6:00 p.m. and will be held in the Board Chambers located on the 2nd Moor of City Hall at 500 W. Markham Street.
