3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH ZMD LAWN SERVICE, IN AN ANNUAL
5 AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-NINE
6 THOUSAND, ONE HUNDRED THIRTEEN AND 40/100 DOLLARS
7 (129,113.40), PLUS APPLICABLE TAXES AND FEES, TO PROVIDE
8 LAWN MOWING AND GROUNDS MAINTENANCE SERVICES AT THE
9 OAKLAND & FRATERNAL HISTORIC CEMETERY PARK; AND FOR
10 OTHER PURPOSES.

12 WHEREAS, after the Oakland & Fraternal Historic Cemetery Park Board approved the bidding of
13 the needed Lawn Mowing and Grounds Maintenance Services for the Oakland & Fraternal Historic
14 Cemetery Park, the City of Little Rock, Arkansas, issued another Invitation to Bid Event No. 2268 for
15 said services; and,
16 WHEREAS, Bid Event No. 2268 split the Cemetery grounds into three (3) separate area line items
17 for bidding; and,
18 WHEREAS, three (3) bids were received pursuant to the bid for these services, and ZMD Lawn
19 Service was the lowest responsive and responsible bidder for all three(3)areas of the Cemetery; and,
20 WHEREAS, on October 26, 2023, the Oakland & Fraternal Historic Cemetery Park Board approved
21 ZMD Lawn Service to provide Lawn Mowing and Grounds Maintenance Services for the Oakland &
22 Fraternal Historic Cemetery Park.
23 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
24 OF LITTLE ROCK,ARKANSAS:
25 Section 2. The City Manager is authorized to enter into a contract with ZMD Lawn Service in an
26 annual amount not to exceed One Hundred Twenty-Nine Thousand, One Hundred Thirteen and 40/100
27 Dollars ($129,113.40), plus applicable taxes and fees, to provide needed Lawn Mowing and Grounds
28 Maintenance Services for the Oakland & Fraternal Historic Cemetery Park, with the possibility of up to
29 two (2) additional one (1)-year terms, or a portion thereof, by mutual agreement of the parties and on the
30 same terms and conditions as the original contract
31 Section 3. The funds for the contract are to come from the Oakland & Fraternal Historic Cemetery
32 Park accounts.
33 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
34 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and
2 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
I 3 resolution.
4 Section 5. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
5 resolution are hereby repealed to the extent of such inconsistency including, but not limited to Little
6 Rock, Ark., Resolution No. 16,091 (September 5,2023).
