HomeMy WebLinkAboutZ-6972 Staff AnalysisFebruary 8, 2001 ITEM NO.: 11 FILE NO.: Z-6972 NAME: Smith Beauty Shop - Conditional Use Permit LOCATION: 9200 Geyer Springs Road OWNER/APPLICANT: Helen Sue Smith PROPOSAL: To obtain a conditional use permit for a beauty shop to be located in a portion of an existing structure on property zoned 0-3, General Office, located at 9200 Geyer Springs Road. ORDINANCE DESIGN STANDARDS: 1. SITE LOCATION: The proposed site is located on the southwest corner of the intersection of Geyer Springs and Denham Drive. 2. COMPATIBILITY WITH NEIGHBORHOOD: The proposed site is zoned 0-3, General Office, as are the properties to the north and east. To the west and south the zoning is R-2, Single Family Residential. Parkview Christian Church lies on the R-2 property to the south. A single family house is on the R-2 property immediately to the west. Office buildings are located across Denham to the north and across Geyer Springs to the southeast. There are apartments across Geyer Springs to the northeast. With proper screening from the residentially zoned areas, Staff believes the proposed use would be compatible with the neighborhood. The Santa Monica, O.U.R., and Allendale Neighborhood Associations, Southwest Little Rock United for Progress, all property owners within 200 feet, and all residents within 300 feet that could be identified, were notified of the public hearing. ON SITE DRIVES AND PARKING: The proposal includes one new access drive from Denham Drive and removing the existing driveway which is very near the corner. Parking for eight vehicles, including one handicapped accessible space is shown in the rear on the proposed site plan. The ordinance standard for a beauty shop is one space for every 200 gross square feet. The proposed 900 square feet would require a minimum of 4 parking spaces. The other 1400 square feet of office space would require 3 spaces based on the ordinance requirement of 1 space for every 400 square feet. The total requirement would be 7 parking spaces with one being van handicapped accessible. 4. SCREENING AND BUFFERS: The western land use buffer width must be a minimum of 9 feet. A 6 -foot high opaque screen, either a wooden fence with its face side directed outward or dense evergreen shrubs, is required along the southern and western site perimeters. This site will be required to be landscaped in accordance with the Landscape Ordinance. This will include curb and gutter or another approved border to protect landscaped areas from vehicular traffic and a water source within 75 feet of all landscaped areas. 5. PUBLIC WORKS COMMENTS: a. Geyer Springs Road is classified on the Master Street Plan as a minor arterial. A dedication of right-of-way 45 feet from centerline, or to back of existing sidewalks, whichever is greater, will be required. b.A 20 feet radial dedication of right-of-way will be required at the corner of Geyer Springs Road and Denham Drive. c. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-of-way prior to occupancy. 2 February 8, 2001 ITEM NO.: 11 (Cont.) FILE NO.: Z-6972 d. Property frontage needs to have the sidewalks and ramps brought up to the current ADA standards. e. Plans of all work in right-of-way shall be submitted for approval prior to start of work. f.Driveways shall conform to Sec. 31-210 or Ordinance 18,031. g. Relocate driveway 10 feet clear from western boundary and close existing driveway. 6. UTILITY, FIRE DEPT. AND CATA COMMENTS: Water: No objection. Contact the Water Works regarding the size and location of the water meter. Contact Carroll Keatts, Water Works Cross Connection Program Administrator at 377-1241, to discuss backflow prevention requirements for this project. Wastewater: Sewer available, not adversely affected. Southwestern Bell: Approved as submitted. ARKLA: Approved as submitted. Entergy: Approved as submitted. Fire Department: Approved as submitted. CATA: Site is near bus routes #17 and #17A and has no effect on bus radius, turnout and route. 7. STAFF ANALYSIS: The applicant has requested a conditional use permit for a beauty shop using 900 square feet of an existing, 2,300 square foot, one story structure zoned for office use. A small 8 -vehicle parking area would be constructed in the rear accessed from Denham Drive. An existing structure would be used with no exterior changes made. Therefore, siting criteria for the structure is not an issue. The parking area would be new and have to meet ordinance requirements. The proposed site plan includes the required landscape buffers and screening fence on the west and south sides of the property. The layout of the parking area would 3 February 8, 2001 ITEM NO.: 11 (Cont.) FILE NO.: Z-6972 be acceptable. The applicant has designed the parking area with the goal of saving existing trees. The minimum parking requirement for the Beauty shop would be 4 spaces based on 1 space for every 200 square feet, and 3 for the office based on 1 for every 400 square feet. Eight spaces, including one handicapped accessible space, are shown on the site plan. The beauty shop would have six chairs and operate between the hours of 8:00 a.m. and 10:00 p.m. Monday through Saturday. Signage, if any, would be within allowances for normal office zoning. Staff believes the proposed use would be a reasonable added use, would be compatible with the neighborhood with proper screening and landscape buffers, and would not have an adverse impact on the area. 8. STAFF RECOMMENDATION: Staff recommends approval of the conditional use permit subject to compliance with the following conditions: a.Comply with the City's Landscape and Buffer Ordinances. b. Comply with Public Works Comments. c.All exterior lighting must be low intensity and directed downward and inward to the property and not towards any residential zoned area. 4 February 8, 2001 ITEM NO.: 11 (Cont.) SUBDIVISION COMMITTEE COMMENTS: FILE NO.: Z-6972 (JANUARY 18, 2001) Helen Smith was present representing her application. Staff gave a brief description of the proposal and briefly reviewed the comments provided to the applicant. Staff clarified the parking, landscaping and screening requirements for the applicant. The applicant provided the proposed operating hours and verified she planned to have six operating chairs. The Committee Chair suggested that the applicant contact the area Neighborhood Associations about the proposal. There being no further issues, the Committee accepted the proposal and forwarded the item to the full Commission for final action. PLANNING COMMISSION ACTION: (FEBRUARY 8, 2001) Helen Smith was present representing her application. There were no registered objectors present. Staff presented the item with a recommendation for approval subject to compliance with the conditions listed under "Staff Recommendation," paragraph 8 above. The item was placed on the Consent Agenda and approved as submitted to include staff comments and recommendations. The vote was 9 ayes, 0 nays and 2 absent. 5
