LOCATION: 6313 West Markham
OWNER/APPLICANT: Ruebel Funeral Home
PROPOSAL: To obtain a conditional use permit to
add a crematorium within the existing
funeral home structure on property zoned
0-3, General Office, located at 6313
West Markham Street.
ORDINANCE DESIGN STANDARDS:
1. SITE LOCATION:
The proposed site is located on the south side of West
Markham, 2 properties east of McKinley Street.
2. COMPATIBILITY WITH NEIGHBORHOOD:
The proposed site is zoned 0-3, General Office, and is
surrounded by C-3, General Commercial zoning. A
convenience store with gas pumps exists directly west.
A one story commercial store lies directly east. To the
north across Markham is Park Plaza Mall. To the south
is a parking garage for University Mall. The City's
vehicle maintenance garage lies to the southwest. The
closest residential property is approximately 300 feet
to the west beyond the convenience store and across
McKinley Street.
Staff believes the proposed use would be compatible
with the surrounding area.
The University Park, Briarwood, and Hillcrest
Neighborhood Associations, all property owners within
200 feet, and all residents within 300 feet that could
be identified, were notified of the public hearing.

3. ON SITE DRIVES AND PARKING:
FILE NO.: Z-6970
The existing funeral home site will not be changed. It
has three access drives from Markham and parking areas
primarily to the west of the funeral home, and a few
parking spaces in front. None of this would be affected
by this proposed use.
4. SCREENING AND BUFFERS:
No comments.
5. PUBLIC WORKS COMMENTS:
With a Building Permit
a.Property frontage needs to have the sidewalks and
ramps brought up to the current ADA standards.
b.Repair or replace any curb and gutter or sidewalk
that is damaged in the public right-of-way prior to
occupancy.
c.Driveways shall conform to Sec. 31-210 or Ordinance
18,031.
6. UTILITY, FIRE DEPT. AND CATA COMMENTS:
Water: No objection. Contact the Water Works
regarding the size and location of the water meter.
Contact Carroll Keatts, Water Works Cross Connection
Program Administrator at 377-1241, to discuss
backflow prevention requirements for this project.
Wastewater: Sewer available, not adversely affected.
Southwestern Bell: Approved as submitted.
ARKLA: Approved as submitted.
Entergy: No comments received.
Fire Department: Approved as submitted.
CATA: Site is located on bus route #5 and near bus
route #21 but has no effect on bus radius, turnout and
route.

7. STAFF ANALYSIS:

The applicant has requested a conditional use permit to
add a crematorium within the existing funeral home
structure on property zoned 0-3, General Office.
A funeral home is a permitted use in 0-3 zoning. A
crematorium may be allowed by a conditional use permit
as part of the services included within a full service
funeral home.
There would be no exterior changes to the existing
funeral home as a result of adding the proposed use.
Therefore, there are no siting issues. The function
would operate potentially anytime during the day or
night as required. That is necessary because the
funeral home must cremate the remains within': -48 hours
of the time of death. The added operation would be
conducted in the basement of the existing facility and
be accessed through the rear. The rear basement area is
of course lower than the front of the building, but at
ground level in the rear. The state-of-the-art
operation internally contains and re -burns all smoke
and odors, thereby creating minimal allowable
emissions. All permitting and licensing by the Health
Department, Department of Environmental Quality, and
the State Board of Funeral Embalmers would be obtained.
Staff believes the proposed use would be a reasonable
added use and not cause any adverse impact on the
surrounding area.
8. STAFF RECOMMENDATION:
Staff recommends approval of the conditional use permit
subject to compliance with the following conditions:
a. Comply with Public Works Comments.
b. Comply with Water Works Comment.
c. Comply with any permitting and licensing
requirements of the Health Department, Department
of Environmental Quality, and the State Board of
Funeral Embalmers.

SUBDIVISION COMMITTEE COMMENTS

Pat McGetrick, project engineer, was present representing
the application. Staff gave a brief description of the
proposal and briefly reviewed the comments provided to the
applicant.
Staff asked the applicant what the hours of operation would
be, if there would be any emissions, and what kind of
permits/licensing was required by the Health Department and
Department of Environmental Quality? Mr. McGetrick stated he
would provide that information.
There being no further issues, the Committee accepted the
proposal and forwarded the item to the full Commission for
final action.
PLANNING COMMISSION ACTION:
(FEBRUARY 8, 2001)
Pat McGetrick, project engineer, was present representing
the application. There were no registered objectors present.
Staff presented the item with a recommendation for approval
subject to compliance with the conditions listed under
"Staff Recommendation," paragraph 8 above.
The item was placed on the Consent Agenda and approved as
submitted to include staff comments and recommendations. The
vote was 9 ayes, 0 nays and 2 absent.
