PUBLIC WORKS COMMENTS: No Comments. B. PUBLIC TRANSPORTATION ELEMENT: The site is not located on a CATA bus route. The nearest route is Route 14 which runs along Colonel Glenn to the east and Shackleford Road to the north. C. PUBLIC NOTIFICATION: All property owners located within 200 feet of the site, all residents located within 300 feet who could be identified, and the John Barrow and SWLR United for Progress Neighborhood Associations were notified of the proposed rezoning. FILE NO.: Z -6957-A (Cont.) D. LAND USE ELEMENT: This request is located in the 65th Street West Planning District. The Land Use Plan shows Commercial for this property. The applicant has applied for C-4 for future retail development. The request does not require a change to the Land Use Plan. City Recognized Neighborhood Action Plan: The property under review is covered by the Pecan Lake — Stagecoach/Dodd Neighborhood Action Plan. The Zoning and Land Use goal states "Maintain and encourage single family and low density residential developments in the residential area of the neighborhood, while encouraging responsible non-residential development in areas currently reserved for such uses on the Future Land Use Plan." STAFF ANALYSI Boen Enterprises LLC, owner of the 13.23 acre tract located at the southeast corner of Colonel Glenn Road and 1-430, is requesting to rezone the property from "C-3" General Commercial District to "C-4" Open Display District. The rezoning is proposed for a future commercial development. The property is currently undeveloped, with some site work having been done recently. This general area at the intersection of Colonel Glenn and 1-430 contains a mixture of commercial and office zoning and uses, with a large amount of undeveloped property. There is undeveloped C-3 and 0-3 zoned property located immediately east and south, with a new office building under construction further south. There is a Wendy's restaurant under construction to the north across Colonel Glenn Road and the Clear Channel facility located to the northeast. There is a car dealership and the Rave Theater located across 1-430 to the west. There is also undeveloped commercial zoned property to the west and northwest across 1-430. The City's Future Land Use Plan designates this property as commercial. The requested C-4 zoning does not require a change to the Land Use Plan. Staff is supportive of the requested rezoning to C-4. Staff feels that the proposed C-4 zoning is appropriate for this site located at the intersection of an interstate and a principal arterial. F. STAFF RECOMMENDATION: Staff recommends approval of the requested C-4 zoning. PLANNING COMMISSION ACTION: (SEPTEMBER 18, 2003) The applicant was present. There were no objectors present. Staff presented the item with a recommendation of approval. The applicant offered no additional comments. The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as recommended by staff. A motion to that effect was made. The motion passed by a vote of 10 ayes, 0 nays and 1 absent.
