That Ordinance No. 18,379 passed on October 17, 2000, be amended to provide for modification of the Planned Zoning Development described as Harp's Short -form PD -R (Z -6883-A), located at 5212 1 Street; SECTION 2. SECTION 7. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION B. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. None. Staff recommends approval of the requested PD -R zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 10 ayes, 0 noes and 1 absent. The Planning Commission reviewed the proposed PD -R request at its January 8, 2009, meeting. There was one registered objector present. The Hillcrest Residents Neighborhood Association, all residents who could be identified located within 300 feet of the site and all property owners located within 200 -feet of the site were notified of the Public Hearing. BACKGROUND The request is to allow a revision to the previously approved PD -R to allow the two (2) lots located along I Street to develop with single-family homes. Residential zoning in the area is primarily R-2, Single-family which typically requires a minimum lot size of 7,000 square feet with a minimum lot width of 50 feet and a minimum Iot depth of 100 feet. The lot widths are currently approximately 44 feet and the proposed lot depth is approximately 85 feet for a lot area of 3,740 square feet. The proposal is to allow these lots to remain zoned PD -R for single-family development with specific development criteria established through the PD -R zoning. The development criteria will closely match the design criteria established by the Hillcrest Design Overlay District as far as front building setback, building height and rear yard setbacks. Staff is supportive of the request. The revision to the PD -R will remove the previous multi -family aspect of the development from I Street and allow the construction of two new single-family homes on I Street. To allow the development to occur, two lots, which do not meet the typical development criteria of the underlying zoning for the area will be created. Staff feels the lots will have sufficient area for construction of new homes. To staff's knowledge there are no outstanding issues associated with the request. Staff feels the removal of the multi -family aspect from the development and the construction of two new single-family homes in this area will have a positive impact on the area. My mother-in-law, Anne Robertson (5209 1 Street) also concurs. Your consideration of the following points would be appreciated: Although the property under consideration for a change from Low Density residential to Multi Family does abut other Multi Family properties to the rear( which face J Street) the two streets are totally different in character and composition. J Street has only one single-family property facing J Street and one other that fronts Harrison with a south exposure to J. The other properties are muliti family. I Street, on the other hand, has ten single-family homes with a distinct residential feel. Even the duplex, which was destroyed on the subject property, had a very distinct residential feel and in fact was converted at some point from a single-family residence. Parking on I Street is a concern now. Even with planned off-street parking, human nature would leave one to believe that many of the potential, 8+ vehicles plus visitors generated as a consequence of this quadplex will be using I Street. The attached Street View of I and J streets from Google shows a random morning view. Even allowing for the water main repair trucks on I Street at the time of the pictures, one can see that the parking pressure on I Street is significantly higher. It represents what would be considered a normal difference for these streets if you reference my forty plus years experience with the area and my mother-in-law's 58 plus years. The Google pictures also indicate the location of this block of I Street with the Holy Souls Church located at one end and Mount Saint Mary's High School directly opposite I Street on Kavanaugh with an exit from the school almost inline with I Street. The normal church and related school traffic adds significant congestion to I Street both with parking and through traffic. St. Mary's also is a factor. During recent school construction, many students used I Street for parking. The effects on future parking of a capital improvement campaign now ongoing for the school should also be considered. ■ Several years ago the H Street access to Kavanaugh and Van Buren was blocked to make that intersection safer. One of the results of this change was to make our I Street block a short cut for many vehicles coming from Cantrell, North Lookout and points north and south from Kavanaugh. A turn on H Street leads quickly to University Avenue for those in the know (as shown on the Google map). Added congestion from this quadplex, would only complicate this problem. 1 understand that the developer is working with the Hillcrest Property Owners Association to find an acceptable plan for the neighborhood. A similar structure to the previously approved quadplex on J Street would not be a good solution. As a residential builder and real estate agent, I empathize with the developer but would hope that a suitable structure can be found which is in keeping with the neighborhood and won't affect values. The Hillcrest area is a unique and very desirable neighborhood unprotected by Bills of Assurance. We count on your good judgment in maintaining its integrity and values. On October 13, 2008, the HRA Board voted to oppose the request by Car Holding, LLC to revise the previously approved Planned Residential Development to allow the demolition of the existing duplex and the construction of a new four-plex on the site. We have several concerns about this proposal. To begin with, it is our understanding that Car Holding, LLC needs approval for any revision to the current PR -D, including demolition of the current duplex structure. However, it appears that Car Holdings has taken significant steps towards demolition prior to receiving the approval. Car Holdings should be required to hold the status quo until specific approval is granted. The existing structure is a freestanding house that has the appearance of a single-family structure. It is located in the middle of a block of freestanding homes. Car Holding proposes to replace this freestanding home with a large structure consisting of four units, overlapping over two lots, with minimal side setbacks. Dear Members of the Little Rock Planning Commission: My business partner, Andrew Adkins, and I own CAR Holdings, LLC. We recently purchased three (3) investment rental buildings and a vacant lot from LR attorney John Gill. The properties we bought are part of a 2000 P.Z.D. filing. Of those properties, one four plex is only a few years old, attractive and in great condition. A six plex is in need of both cosmetic and structural repairs that are being undertaken at this time. It is our belief that the duplex is beyond cost effective repair, remodel or updating. Given our feelings toward the duplex, we donated the structure as a whole to Habitat for Humanity. They have removed from the property any and all items they felt would be reusable in their charity. We have now applied for and received a demolition permit for this likely unsafe structure. We expect a code official's letter any day requesting we secure/board the structure. Before we undertake the demolition action, we felt it prudent that we seek approval to build the new staggered 4-plex. The duplex is located next to the vacant lot. Herein we have submitted a proposed site plan that would reflect a staggered 4-plex, (town home style) to occupy both the lot currently occupied by the duplex and the vacant lot. Given the proximity of the duplex lot and the vacant lot to each other, it seemed to make better sense to do an attractive 4 plex design rather than 2 separate duplexs ( if that were to be allowed. ) We plan to offer off-street parking, (possibly illuminated), a concealed group trash receptacle, abundant decorative landscaping, including planting a few new trees. No existing trees will be removed with our project plan. We plan to approach all of the local and affected landowners, (by Ordinance) and associated property owner associations to seek their buy -in to our neighborhood improvement plan. We think our project is a positive improvement to the area and with our strict application and approvals process would add only 2 additional units to the area. We respectfully request this new P.Z.D. be favorably considered as a betterment for the neighborhood, and an attractive addition to the area.
