3 A RESOLUTION TO AMEND RESOLUTION NO. 16,119 (SEPTEMBER
4 19, 2023), TO AUTHORIZE THE CITY MANAGER TO EXPEND THE
5 SUM OF TWO MILLION DOLLARS ($2,000,000.00) IN ECONOMIC
6 DEVELOPMENT FUNDS TO ASSIST WITH THE PORT SUPERSITE
7 WITHIN THE LITTLE ROCK PORT; AND FOR OTHER PURPOSES.

9 WHEREAS, Little Rock, Ark., Resolution No. 16,119 (September 19, 2023), is hereby amended to
10 remove language unrelated to this matter; and,
11 WHEREAS, in Little Rock, Ark., Ordinance No. 10,957 (July 6, 1959) -- pursuant to the authority
12 granted in Ark.Code Ann. § 14-186-103 --the City of Little Rock,Arkansas("the City")created the Little
13 Rock Port Authority("the Authority"),and this ordinance is codified as Little Rock,Ark.,Rev.Code§25-
14 1 (1988);and,
15 WHEREAS, State Statute enables the City to take actions and expend funds for economic
16 development through a port authority, and to help build improvements "in or near any city or town in the
17 State of Arkansas," Ark. Code Ann. § 14-186-204 (a)(1), and also to promote improvements
18 "within or without the corporate limits of the city,"Ark. Code Ann. § 14-186-205;and,
19 WHEREAS, pursuant to Little Rock, Ark., Ordinance No. 22,234 (March 7, 2023), the Board of
20 Directors approved adjustments to the comprehensive budget for the City of Little Rock,Ark. in Ordinance
21 No.22,079(December 21,2021);and,
22 WHEREAS, in Little Rock, Ark., Resolution No. 16,119 (September 19, 2023). the Board of
23 Directors authorized the City Manager to expend the sum of Two Million Dollars ($2,000,000.00)to the
24 Little Rock Port Authority to fund the Port Supersite as an Economic Development Project;and,
25 WHEREAS,a sum of Two Million Dollars($2,000,000.00)is included in the Economic Development
26 Funds set aside to develop the Port Authority Supersite;
27 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
28 OF LITTLE ROCK,ARKANSAS:
29 Section 1. The City Manager is authorized to expend the sum of Two Million Dollars($2,000,000.00)
30 to the Little Rock Port Authority to fund the Port Supersite as an Economic Development Project.
31 Section 2. Funds for this expenditure are available in the Economic Development Account No.
32 108129-S100521 from the 2022 Budget Amendment.
33 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
34 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
35 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
2 resolution.
3 Section 4. Repealer. All laws, ordinances, resolutions, including but not limited to Little Rock, Ark.
4 Ordinance No. 22,234(March 7,2023)and Little Rock, Ark. Resolution No. 16,119(September 19,2023),
5 or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the
6 extent of such inconsistency.
