Staff Report:
A. Public Works Issues:
No issues.
B. Staff Analysis:
The R-2 zoned property located at 2416 Grist Mill Road is
occupied by a one-story, rock and frame, single-family
residence. The occupant of the home is proposing to conduct
a home occupation in an accessory building which has been
constructed in the rear yard. Section 36-253(b)(6)a5
prohibits home occupations which involve accessory
buildings.
Staff is supportive of the requested variance. The
applicant is a broker of cattle hides to tanneries in
Mexico. He is the only employee of the business. There is
no inventory, no customer or client traffic and no outward
visible evidence of a business being conducted on the site.
The applicant has stated that there is not a room in the

house which can be converted into an office and he has no
desire to move to a new home which would be large enough for
his family and would provide an office space.
The 12' X 16' (192 sq. ft.) building is considerably smaller
than the area the applicant could use by -right as an office
in his home (500 sq. ft.). There is no plumbing to the
building, only electricity and telephone.
Staff does not believe that allowing the applicant to use
the accessory building as his office, as described in his
application, will negatively impact adjacent properties.
C. Staff Recommendation:
Staff recommends approval of the variance to allow the
applicant to use the 12' X 16' accessory building for his
office, as described in his application, subject to
compliance with the following conditions:
1. There is to be only one employee - the applicant.
2. There is no walk-in or drive -up traffic to the
business.
3. No signage is permitted beyond that allowed in single-
family zones.
4. No inventory is to be kept on the property.
BOARD OF ADJUSTMENT:

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the following conditions:
1. There is to be only one employee - the applicant.
2. There is no walk-in or drive-in traffic to business.
3. No signage is permitted beyond that allowed in single-family
zone.
4. No inventory is to be kept on the property.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 5 ayes, 0 noes and 0 absent.
