Applicant's Statement: I am
requesting a variance from the
requirements of the Zoning
Ordinance in order to preserve a
very old and beautiful hickory tree
in my yard. I had an 11' X 18'
awning placed on my concrete drive
in order to protect my vehicle from
dents caused by the falling nuts
and limbs from the tree.

B. Staff Analysis:
The R-2 zoned property located at 5901 Scenic Drive is
occupied by a single family home. The occupant of the home
has recently erected a freestanding, 11' X 18' carport
structure on the property. The structure actually extends
into the Grant Street right-of-way. The applicant has been
advised that the structure must be moved out of the right-
of-way. He is asking that the structure be permitted to
have a front yard (Grant Street) setback of 3 feet. The
Code requires accessory structures to have a minimum front
yard setback of 60 feet.
Staff supports the requested variance, if the structure is
moved 5 feet to the west (out of the Grant Street right-of-
way). The carport is built of a metal framework with a
canvas top. The sides are unenclosed. Although the lot's
front yard is taken from Grant Street, the home faces Scenic
Drive, giving the carport the appearance of being located in
the side yard, not the front yard. If the carport is moved
5' to the west, it will sit back from the curb of Grant
Street 91, providing adequate separation from traffic in the
street. Grant Street is not, at this point, a heavily
trafficked street. Grant Street ends at a "T" intersection
with Scenic Drive. Allowing the unenclosed structure to
have a reduced setback should have no impact on traffic in
the street or on adjacent properties.
The structure was noticed by a staff member while on an
unrelated inspection in the area. There were no
neighborhood complaints about the carport.
C. Staff Recommendation:
Staff recommends approval of the requested front yard
setback variance subject to the following conditions:
1. The carport structure is to remain open and unenclosed.
2. The carport structure is to be moved 5' to the west,
out of the Grant Street right-of-way.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the following conditions:
