A variance is requested from
the accessory structure area
regulations of Section 36-156 to
permit an accessory structure with
a reduced rear yard setback.
Applicant's Statement: We are
respectfully asking for a variance
of codes with the following reasons
listed below:
1_ The property is located on a
steep slope.
2. The property has such an odd
shaped lot.
3. We're trying to conserve the
big oak tree and three red
maple trees that were left
standing after the house was
built.
4. Only the northwest corner of
the structure in question,
which is a "gardening tool
shed" is close to the
neighbor's fence. The
northeast corner of the shed
is more than 3 feet away from
the fence.

B. Staff Analysis:
The applicant was advised by the property owner's
association that the structure was in violation of the Bill
of Assurance and must be removed. The applicant has stated
that he will remove the structure and will not pursue the
variance request. He has withdrawn the application.
C. Staff Recommendation:
Staff recommends approval of the applicant's request to
withdraw the application.
BOARD OF ADJUSTMENT:
(DECEMBER 27, 1999)
The applicant was not present. There were no objectors present.
Staff informed the Board that the applicant had requested that
the item be withdrawn.
The item was placed on the Consent Agenda and approved for
withdrawal by a vote of 5 ayes, 0 noes and 0 absent.
