A variance is requested from
the area regulations of Section 36-
254 to permit construction of an
addition with a reduced side yard
setback.
Applicant's Statement: We are
requesting a zoning variance of the
west side yard setback from an
existing 6.4' width to 11-10" from
the western property line.
The house's south (rear) elevation
faces Allsopp Park woods and is on
a steep incline. The lower (grade)
level of the addition will be a
2 car carport entered from the east
with a 4'-0" extension of enclosed
storage along the west side. Above
the carport will be a new den
aligning with the existing dining
room projection towards the south,
and a new bathroom and storage
closet along the west wall above
the carport storage below. This
configuration results in a reduced
western side yard setback of
1"-10". The west roof edge at the
new addition will have a maximum
overhang of 3" with a gutter which
projects no more than 611.

B. Staff Analysis:
The R-2 zoned property located at 4801 Crestwood is occupied
by an older, two-story, brick and frame, single-family
residence. The applicants propose to construct a two story
addition onto the rear of the house. The addition will
contain a carport and storage on the ground floor and a new
den, bathroom and storage on the upper floor. The addition
is proposed to have a side yard setback on the west side of
1'-10". The code requires a side yard setback of 5' for
this lot.
Staff believes the variance request to be reasonable. The
new addition will have a maximum overhang of 3" with a
gutter which projects no more than 6", resulting in a
setback of 1'-1" from the nearest edge of the structure to
the side property line. The addition is designed to tie
into the existing dining room at the rear of the house. The
architect has stated that placing the addition as proposed
is both more architecturally desirable and visually
pleasing. The house on the adjacent lot is separated from
this site by a driveway, providing a setback of 121± at the
closest to 251± at the point across from the proposed
addition. The owner of this adjacent property has submitted
a letter (attached) in support of the applicant's proposal.
C. Staff Recommendation:
Staff recommends approval of the requested side yard setback
variance subject to guttering being placed on the addition
to prevent water run-off onto the adjacent property.

The applicant was present. There were no objectors present.
