A variance is requested from
the area regulations of Section
36-254 to permit construction of a
residence with a reduced rear yard
setback.
Due to the pie -shaped configuration
of the lot, the desired house will
not fit on the lot without a
variance. The reduced rear yard
should not impact other properties
since this lot backs up to a lake.
Vacant lot
Single Family residence
The applicants propose to construct a new, single-family
residence on the vacant, R-2 zoned lot located at #7 Cypress
Cove. The house is proposed to have a rear yard setback of
17.5 feet. The Code requires a rear yard setback of 25 feet
for this lot.
Staff is supportive of the variance request. The specific
home proposed by the applicants is 77.6 feet deep. When the
depth of the house is combined with the 25 foot front
building line, a small portion of the structure extends into

the rear yard setback. The encroachment is minor and should
have no effect on adjacent properties. The rear line of
this lot abuts an open space and a lake. The developer of
the Subdivision, including the lake, has given approval for
the proposed home and the requested variance.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved by a vote
of 4 ayes, 0 noes and 1 absent.
