A variance is requested from
the area regulations of Section 36-
254 to permit construction of new
home with a reduced rear yard.
The configuration of the lot has
created a problem with constructing
the home the applicants propose to
build on the lot. The property
backs up to an open space and a
lake. The reduced rear yard will
have no impact on other properties.

Single Family
The applicants propose to construct a new single family home
on the R-2 zoned lot located at 12 Pinnacle View Cove. Due
to the design of the particular house proposed for
construction on the lot, a variance is needed to allow for a
reduced rear yard setback of 12 feet. The code requires a
rear yard setback of 25 feet for this lot.
Staff believes the variance request to be reasonable. The
lot is "pie -shaped", being much narrower at the front than
at the rear. The house has a side -loaded garage, requiring

more room at the side and pushing the garage towards the
rear of the lot. Only a relatively small portion of the
house is to be built across the 25 foot rear yard setback,
leaving most of the required rear yard uncovered. The
property backs up to a lake and open space. Reducing the
rear yard will have no effect on other properties. The
developer of the subdivision has approved the proposed home
and reduced rear yard.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance.

Staff presented the item and a recommendation of approval.
