Justification: The site has no covered parking. Due to the building line and the slope of the site, there is little choice where to place the structure. Public Works Issues: Parallel Parking in Front of House Parking shall be restricted to parallel; no parking perpendicular or at an angle to the street. Generally this will limit parallel parking area to about 8 -feet width with additional width of about 5 -feet away from on -street traffic. Wall extending across property line into right-of- way shall taper in height "into" ground level nearer the street so as not to present safety hazards of structural abutments in the right-of-way. October 25, 1999 Item No.: 4 (Cont.) Carport Structure No vehicles will be permitted to overhang street curb or future sidewalk. B. Staff Analvsis: The R-2 zoned lot located at 13 Pine Manor Drive is occupied by a one-story, brick and frame, single-family residence. The applicants propose to construct a detached carport structure in the front yard area north of the house. This accessory structure will have a front yard setback of 6 feet and will be built across a platted 35 foot building line. The code requires a front yard setback of 60 feet for this lot. Staff believes the variance request to be reasonable. The only undeveloped portion of the property not restricted by the building line is the small area south of the house. A two car carport could not be built in that area either without a front yard or side yard setback variance. Additionally, placing the carport on the north side of the house is more desirable for access to the house and the property is somewhat more level with the street at that point, requiring less grading for the driveway and carport. The proposed carport is open and unenclosed, consisting of 4 support posts and a pitched, pavilion -type roof. The structure sits 16 feet from the curb of Pine Manor, which is a circle street. Placement of the structure where proposed should have no impact on traffic in the street and should not create a sight -distance hazard. The carport structure is somewhat out of character for the immediate neighborhood but the presence of several large pine trees and a large magnolia tree which screen the structure will help to mitigate the impact of the reduced setback. If the Board approves the building line variance, the applicant will have to do a one -lot replat reflecting the change in the building line as approved by the Board. The applicant should review the filing procedure with the Circuit Clerk's office to determine if the replat requires a revised Bill of Assurance. 2 October 25, 1999 Item No.: 4 (Cont. C. Staff Recommendation: Staff recommends approval of the requested setback and building line variances subject to compliance with the following conditions: 1.A one -lot replat reflecting the change in the building line as approved by the Board. 2. Compliance with Public Works Comments 3. The carport is to remain open and unenclosed. BOARD OF ADJUSTMENT: (OCTOBER 25, 1999) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the conditions outlined in the " Staff Recommendation" above. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff, including all conditions. The vote was 5 ayes, 0 noes and 0 absent. 3
