Address: 12821, 12825, 12901, 129051 129071 12911, 12915 and 12919 Westglen Drive Description: Lots 42-49, Westhampton Subdivision Zoned: R-2 Variance Requested: A variance is requested from the fence height provisions of Section 36-516 to permit construction of a 6 foot tall privacy fence along the rear property line of these lots. Justification: Applicant's Statement: We are herewith requesting a variance which will allow us to construct a 6 foot privacy fence at the property line of lots 42 through 49 Westhampton along Gamble Road. Homes on these lots will face West Glen Drive with the rear of the homes exposed to Gamble Road. We believe that a privacy fence will make the drive along Gamble Road more attractive, will pose no sight line problems, and be more pleasing to the homes built on the opposite side of Gamble Road. Future purchasers of the homes to be built on these lots will appreciate the privacy and security this type of fence will provide. Staff Analysis• Lots 42-49, Westhampton Subdivision are double frontage lots located in a newly developing residential subdivision. The properties are zoned R-2. The lots front onto West Glen Drive and the rear lot lines abut Gamble Road. The lots were platted with a 25 foot building line on both frontages and a no vehicular access easement on the Gamble Road persmeter. The lots are currently vacant, with the exception of two homes currently under construction. The applicant proposes to construct a 6 foot tall privacy fence along the rear (Gamble Road) property line of these 8 lots. Section 36-516 of the code limits the height of fences erected within the required setbacks adjacent to streets to 4 feet. Staff believes the variance request to be reasonable. None of the lots in question are corner lots and all have the vehicular access prohibition. The fence will be located 8- 10 feet off of the curb of Gamble Road and should not create a sight distance problem. C. Staff Recommendation: Staff recommends approval of the requested fence height variance subject to the fence being constructed in "good neighbor" fashion, with the finished side facing outward. BOARD OF ADJUSTMENT: (SEPTEMBER 27, 1999) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to the fence being constructed in "good neighbor" fashion, with the finished side facing outward. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 4 ayes, 0 noes and 1 absent. 2
