Variance Requested: A variance is requested from the
area regulations of Section 36-254
to permit an addition with a
reduced rear yard setback.
Justification: Applicant's Statement: We are
needing an addition to our house
due to growing family. Due to
irregular shape of the property the
only direction to add to this house
is the backyard. Our proposal
leaves 12' of backyard for
landscape buffer and 10' of side
yard at the narrow side. Our
addition is going to be one story
stucco structure with windows
toward the alleyway. We would be
matching the eave height of the
existing house and the roof will be
matching material and color of the
original house to ensure the
unifying visual appearance. We are
certain that the addition and the
original house are going to be well
fit for the neighborhood.

Staff Report :
A. Public Works Issues:
Applicant must design propose addition not to create surface
water problem to adjacent property owners.
B. Staff Analysis:
The R-2 zoned property located at 4513 Kenyon Street is
occupied by a small, one-story, brick and frame, single
family residence. The applicants propose to build an
addition onto the rear of the house containing a bedroom and
bathroom. The addition will result in a rear yard setback
of 3 feet. The Code requires a rear yard setback of 25 feet
for .this lot.
Although the variance request is substantial, staff is
supportive. The lot is very substandard in size and any
addition would very likely require a variance. The lot
varies in depth from 85 feet to 92 feet and in width from 40
feet to 73.8 feet. As it is the house has a rear yard
setback of 17 feet. An alley is located on the west side.
The alley is used by several nearby properties. The
property adjacent to the rear fronts onto Ash Street. The
applicant's property is adjacent to the rear yard of this
Ash Street property. The Ash Street property extends west
to the aforementioned alley. A storage building and a
carport are located on this adjacent property at the point
nearest the applicant's property. The applicant has stated
that no windows will be located in the south wall of the
addition. The windows will be located in the west wall,
overlooking the yard toward the alley. Staff does not
believe the proposed addition will impact adjacent
properties.
The 3 foot setback will be measured to the wall of the
addition. Staff believes it is appropriate to limit any
eave or overhang on the south side of the addition to 6
inches. The addition will be designed to match the house
and the roof will be pitched toward the sides, not the rear.

C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to compliance with the following
conditions:
1. Any eave or overhang on the south side of the addition is
to be limited to 6 inches.
2. The roof of the addition is to be designed to pitch
toward the sides, not down toward the rear.
3. There are to be no windows in the south side of the
addition (as proposed by the applicant).

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the 3 conditions outlined in Section "C"
above.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes and 1 absent.
