B. Staff Analysis:
The R-3 zoned property located at 420 Johnson Street is
occupied by a one-story, frame, single family residence and
a detached 612.75 sq. ft. accessory building (garage). The
applicant proposes to tear down this old, deteriorated
garage and replace it with a new 720 sq. ft. garage. 600
sq. ft. of the structure will be located in the required
rear yard, covering 48% of the required rear yard. The code
limits the size of accessory buildings in the required rear
yard to a maximum coverage of 30%. The applicant also
proposes to construct an 8 foot tall privacy fence along the

south property line, where his property is adjacent to an
apartment building and a parking lot. The code limits the
height of fences in the residential districts to 6 feet.
Staff is supportive of the requested variances. The
existing garage building has a side yard setback on the
south side of 0.2 feet. The entirety of the existing garage
is located in the required rear yard (612.75 sq. ft., 49%
rear yard coverage). The proposed new structure will meet
or exceed all required setbacks. Only 600 sq. ft. of the
new structure will be located in the required rear yard for
a coverage of 48%. Staff believes the applicant is making
an improvement by providing the proper setbacks and by
reducing the rear yard coverage by lis.
The property adjacent to the south is occupied by a two-
story, 10 unit apartment building. The apartment parking
lot and the building's dumpster are located directly
adjacent to the applicant's rear yard. Allowing the minor
fence height variance, from 6 feet to 8 feet, should not
impact the adjacent property and should be of benefit to the
applicant, enhancing his property and allowing him to enjoy
his back yard.
The structure is proposed to have a setback of 4.8 feet from
the alley. Once the required right-of-way is dedicated, the
structure will have a setback of .8 feet. No setback is
required adjacent to the alley.
C. Staff Recommendation:
Staff recommends approval of the requested area coverage and
fence height variances as filed subject to compliance with
Public Works comments including any variance of those
requirements as may be granted by the Board of Directors.
