B. Staff Analvsis:
The HDR zoned property located at 1104 Rock Street is
occupied by a one-story, frame, residential structure and a
detached accessory building. The applicants propose to
remove the existing accessory building and replace it with a
new, two -car garage. The new garage will have a rear yard
setback of 5 feet from the property line adjacent to the
alley. A rear yard setback of 20 feet is required for all
structures on HDR zoned properties. Additionally, the

applicants propose to enclose the rear yards of this
property and the adjacent property at 1112 Rock Street with
an 8 foot tall privacy fence. Section 36-516 of the code
limits the height of fences in the residential zones of the
City to 6 feet.
Staff is supportive of the requested variances. The HDR
District does not provide for separate setback requirements
for accessory structures as the other single family
districts do. If the property was zoned R-1, R-2 or R-3
(the other single family districts in the City) the required
rear yard setback for an accessory structure adjacent to an
alley would be 0 feet. The applicant is proposing a rear
yard setback of 5 feet. All other -required setbacks are met
or exceeded. Every other property in this block is occupied
by a structure with a rear yard setback similar to or less
than that proposed by the applicant. The property across
the alley is occupied by a commercial business. The garage
is being designed in a style compatible with the home.
Allowing the reduced setback should have no affect on
adjacent properties.
The applicants propose to enclose the rear yards of 1104 and
1112 Rock Street with a privacy fence totaling 8 feet in
height. The proposed fence will have 6 feet of solid wood
for privacy topped by 2 feet of lattice. The fence has been
designed to be architecturally compatible with the homes and
should have no impact on adjacent properties. The fence
should be designed with the finished side facing outward.
The property is located in the MacArthur Park Historic
District and all work proposed must be approved by the
Historic District Commission.
C. Staff Recommendation:
Staff recommends approval of the requested setback and fence
height variances subject to compliance with the following
conditions:
1. Compliance with Historic District Commission
requirements.
2. The fence is to be designed with the finished side
facing outward.

Staff presented the item and a recommendation of approval subject
to -compliance with the conditions outlined in the "Staff
Recommendation" above.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes and 1 absent.
