A variance is requested from the
fence height provisions of Section
36-516 to permit construction of a
privacy fence which exceeds 4 feet
in height.
The fence is to be located in the
same location as a fence which was
removed to allow for construction
to occur in the rear yard. The
previous fence was 6' in height.
The applicant is requesting
approval to rebuild in the exact
location as the previous fence for
security and insurance reasons.
The fence serves as a portion of
the enclosure for a swimming pool
area.

B. Staff Analysis:
The R-2 zoned lot located at 74 Robinwood Drive is occupied
by a two-story, brick and frame, single-family residence.
The applicant recently constructed a new swimming pool in
the rear yard of the property. Associated with the pool,
was a substantial remodeling of the landscaping and patio
area in the rear yard. To facilitate access to the rear

Staff believes the variance request to be reasonable. The
proposed new fence is to be erected in exactly the same
location as the older fence which was removed for the rear
yard construction project. The fence will adjoin a 7 foot
tall fence on the property adjacent to the south. The fence
is located 13± feet from the curb of the street. Hillandale
is a short residential street, connecting the north and
south ends of Robinwood Drive. It does not appear that
allowing the fence will create a sight -distance issue nor
will it impact traffic on the street. The fence will
provide needed privacy and security for the swimming pool
and should not have a negative effect on adjacent
properties.
