line provisions of Section 31-12 to
permit construction of a carport
with a reduced front yard setback
and which crosses a platted
building line.
Justification: Applicant's Statement: We are
requesting a zoning variance at
5618 Edgewood Road to allow an
encroachment of 10 feet into the 15
foot front building line for the
purpose of constructing a carport
on an existing concrete parking
pad. The steepness of the site
precludes locating the carport
elsewhere. Several houses in this
block have carports in front of
their houses and located relatively
close to the street. We feel this
addition will blend well with the
current architectural context.
Our proposed plan includes a two
story addition to the rear, a one
story screened porch and stair
addition to the south side and a
one story two -car carport to the
east (front). The northeast corner
of the carport will need to
encroach into the front building
line to provide cover for the
entire length of the cars housed on
the existing pad. The roof over

C. Public Works Issues: No Comments.
B. Staff Analysis:
The R-2 zoned lot located at 5618 Edgewood Road is occupied
by a two-story, brick and frame, single-family residence.
The lot slopes so steeply down from the street that the
upper floor is near the street level. The property has no
covered parking. The applicants park on a paved parking pad
near the street. The applicants propose to construct a
1618" X 2410" open carport with a small storage area over
the existing paved parking pad. An unenclosed, covered
walkway will extend from the carport to the house, tying
into a screened porch. The detached carport structure will
have a front yard setback of 5 feet. The Code requires a
front yard setback of 60 feet for accessory structures in
the R-2 district. Additionally, the carport will be built
across a platted 15 foot building line.
Although the request is for a fairly substantial setback
variance, in this case, staff is supportive of the proposal:
The site has no covered parking and the carport will be
built over the existing paved parking pad. This portion of
Edgewood Road, west of Wildwood, is a cul-de-sac with very
little traffic. The grade of the property across Edgewood
rises substantially from the street and there are no
driveways on that side of the street. Those homes front
onto Sherwood Road. A very similar structure is located in
front of a home two lots past this site. Other additions
are proposed for the side and rear of the house. These
additions meet required setbacks. Due to the terrain and
the presence of a very large drainage easement across the
rear 1/3 of the property, there is little option available
for placement of the carport. Staff does not believe

allowing the carport will negatively impact adjacent
properties or traffic on Edgewood.
A small portion of the proposed carport intrudes upon an
easement on the south side of the lot. Approval for the
encroachment has been received from the public utility
companies and Public Works. At Water Works' request, the
carport was pulled back slightly from the front property
line. The 5 foot setback requested conforms to Water Works'
request.
If the Board approves the building line variance, the
applicant will have to do a one -lot replat reflecting the
change in the building line as approved by the Board. The
applicant should review the filing procedure with the
Circuit Clerk's Office to determine if the replat requires a
revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested setback and
building line variances subject to compliance with the
following conditions:
1. A one -lot replat reflecting the change in the building
line as approved by the Board.
2. The carport is to remain open and unenclosed other than
for the small storage area shown on the site plan.

Carolyn Lindsey was present representing the application. There
were no objectors present. Staff presented the item and a
recommendation of approval, subject to compliance with the
conditions outlined in the "staff recommendation" above.
The applicant offered no additional comments.
The item was placed on the consent agenda and approved as
recommended by staff. The vote was 5 ayes, 0 noes and 0 absent.
