Justification: Additional parking is needed for the adjacent commercial use. A well designed parking lot will not impact the adjacent neighborhood. Present Use of Proper : Vacant lot Proposed Use of Property: Parking lot Staff Report: A. Public Works Issues: 1. Arch Street is listed on the Master Street Plan as a principal arterial, dedication of right-of-way to 35 feet from centerline will be required. 2. Property frontage needs to have the sidewalks and ramps brought up to the current ADA standards. B. Staff Analvsis: The applicant proposes to construct a 15 space parking lot on the R-4 zoned property located at 2511 Arch Street. The parking lot will support uses on the C-3 zoned property adjacent to the north at the corner of Roosevelt and Arch Streets. Section 36-507(b) states that parking must be located on property which is zoned to allow the principal May 24, 1999 Item No.: 3 (Cont.) use which the parking will serve or it must be approved by the Board of Adjustment. Staff is supportive of the requested variance. Development of a properly designed, landscaped and screened parking lot on this vacant lot should have no impact on the adjacent properties. The proposed parking lot will serve the neighborhood better than the existing "weed -lot." The parking lot will be screened by landscaping and a 6 foot wood fence on the south and east sides, focusing activity on the site to the north where the parking lot is adjacent to the commercial building. A slight modification to the plan must be accomplished to address the right-of-way dedication requirement. An additional 5 feet is required by the Master Street Plan. This will result in the loss of 1 parking space, leaving 14. No lighting of the parking lot is proposed on the site plan. If lighting is proposed, it must be low-level and directional, aimed away from adjacent residential properties. C. Staff Recommendation: Staff recommends approval of the requested variance to allow for construction of a parking lot on the R-4 zoned property at 2511 Arch Street subject to compliance with the following conditions: 1. Compliance with the City's Landscape and Buffer Ordinances 2. Compliance with Public Works Comments, including any variance of those requirements as may be granted by the Board of Directors. 3. Any lighting of the parking lot must be low-level and directional, aimed away from adjacent residential properties. 4. Submission of a revised site plan addressing those issues outlined above. 2 May 24, 1999 Item No.: 3 (Cont.) BOARD OF ADJUSTMENT: (MAY 24, 1999) Ron Woods and Sandra Joshua Givens were present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval, subject to compliance with the conditions outlined in the "staff recommendation" above. Staff informed the Board that the applicant had sent area property owners a copy of the application, not the "notice of public hearing" on May 12, 1999. When staff became aware of this, the applicant was advised to send a copy of the correct notice form. This was done on May 19, 1999, 5 days prior to the public hearing. Both notices were sent via certified mail. The applicant offered no additional comments beyond acknowledging his error. A motion was made to waive the bylaws and to accept the notice as performed by the applicant. The motion was approved by a vote of 5 ayes, 0 noes and 0 absent. A motion was then made to approve the requested variance, subject to compliance with the conditions outlined in the "staff recommendation" above.
