WHEREAS, an application was filed by KDA Real Estate, LLC with the Little Rock Planning Commission for a revised Conditional Use Permit to allow for a ground -mounted sign to be erected on the 0-2 zoned property described as Lot 3, Hampton -Goff Subdivision located at 1219 South Shackleford Road; and WHEREAS, the proposed ground -mounted sign was to be twenty (20) feet in height and one hundred twenty-five (125) square feet in area; and WHEREAS, the Little Rock Planning Commission, at its November 29, 2001 meeting, denied the application for a revised Conditional Use Permit, as filed; and WHEREAS, KDA Real Estate, LLC has appealed the action of the Little Rock Planning Commission in denying that revised Conditional Use Permit; and WHEREAS, the application has been amended to request a ground -mounted sign of six (6) feet in height and seventy-five (75) square feet in area which more nearly conforms to the sign standards for office zoned property; and WHEREAS, the Little Rock Board of Directors has determined it is appropriate to approve the revised Conditional Use Permit, as amended by the applicant. Shackleford Road. The properly is presently owned jointly by Now Project, LLC (managed by Wally Allen) and Moses Family Investments, LLC (managed by Jimmy Moses). The property is scheduled to be purchased by my company for the development of a credit union office and branch facility. The real estate transaction is being handled by Moses Tucker Real Estate (on behalf of the Sul ler) and The Hathaway Crroup (on behalf of the Buyer). Our development required site plan review by the city, and our proposal site plan involved a requested variance for a pylon sign which the planning staff did not support and which we were unable to resolve prior to or during the Planning Commission meeting on November 29. Although the Planning Commission approved the other elements of our site plan, they denied our requested sign at that meeting. We have appealed that decision to the Board of Directors. However, we have now met with the planning staff and have agreed to utilize a sign which is much less intensive than the pylon sign we had proposed earlier, and which is in keeping with suggestions voiced by various Planning C'otnmissionem at the public hearing. Therefore, wo are amending our appeal by asking the Board of Directors to approve this much smaller sibs,, not the sign that the Planning Commission denied. The Planning Director and staff support this amended appeal. I have attached a sketch of the sign that we lhave presented to the staff (a 6 ft tall monument sign with a 75 SF sign face). They have confirmed that, with this specific amendment to our request, they support it. (Z -6762-B) SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION BACKGROUND Action Required I Submitted By Ordinance 4Resolution Approval Information Report Cy Carney City Manager The applicant is requesting that the Board rescind the Planning Commission's action in denying a revised Conditional Use Permit for Lot 3, Hampton -Goff Subdivision located at 1219 S. Shackleford Road. The applicant has amended the request since the Planning Commission hearing. I None Staff recommends approval of the revised Conditional Use Permit, as amended by the applicant; approval of the resolution to rescind the Commission's action. The Planning Commission reviewed this issue at its November 29, 2001 meeting. There was one objector present. All owners of property located within 200 feet of the site, all residents within 300 feet who could be identified and the John Barrow and Sandpiper Neighborhood Associations were notified of the request. The Commission voted 0 ayes, 8 noes, 2 absent and 1 recusing (Downing) to deny the request, as filed. On November 11, 1999, the Commission approved a conditional use permit to allow a three -lot development on the 0-2 zoned property at 1219-1225 S. Shackleford Road. A hotel was approved on the larger of the three lots and restaurants were approved for each of the two smaller lots that front onto Shackleford Road. The three -lot development was tied together as a single conditional use, with variances and conditions being attached to the overall development. The hotel has BACKGROUND CONTINUED subsequently been constructed and is now in operation. The applicant proposes to construct a credit union branch on one of the two remaining smaller lots; Lot 3. A bank or credit union is a permitted use in 0-2 and if the applicant had submitted a site plan that conformed to the development plan approved by the Commission in 1999, staff would have dealt with the issue at staff level. When the three -lot conditional use permit was approved in 1999, a variance was granted allowing for a single, 20 foot tall, 10 feet wide, monument style sign to serve all three lots. The ordinance maximum for ground -mounted signs in the office district is 6 feet in height and 64 square feet in area. The 200 square foot monument sign was approved subject to no additional ground -mounted signs being placed on the site. Based on that variance, the hotel received a sign permit for and erected a 20 foot tall, 105 square foot sign during the summer of this year. Additional panel space is available for the two remaining lots to place their signs. The applicant asked to be allowed to erect a separate, 20 foot tall, 125 square foot ground - mounted sign on Lot 3 to serve only the credit union. During the November 29, 2001 Planning Commission meeting, the applicant was asked if he would amend the application to request office standard signage for the site. Ruth Bell, of the League of Women Voters stated the League could support office signage for the site. After conferring with his client, the applicant decided to pursue the request as filed. The Commission voted unanimously to deny the request for a 20 foot tall, 125 square foot ground -mounted sign. The applicant has filed an appeal, asking that the Commission's denial be rescinded. The applicant has amended the request and is now requesting a 6 foot tall, 75 square foot ground -mounted sign. That sign conforms to office standards for height and is only 11 square feet larger than the permitted size of 64 square feet in the office district. Staff is supportive of the request, as amended. Staff believes the request now conforms to the intent of the Planning Commission to allow office standard signage for the lot. Consequently, staff recommends approval of the resolution to rescind the action of the Planning Commission and to approve the Conditional Use Permit, as amended.
