A variance is requested from the
area regulations of Section 36-254
to permit a covered patio addition
with a reduced rear yard setback.
The house is built to the required
25 foot rear yard setback. A lake
is located directly to the rear of
the lot. No persons would be
impacted by the reduced rear yard
setback.

A. Public Works Issues: No Issues.
B. Staff Analysis:
The R-2 zoned lot at #5 Cypress Cove is occupied by a new,
two-story, brick and frame single-family residence. The
home is the only one on this new residential street. The
applicants are seeking permission to build a roof over the
existing patio at the rear of the house. The patio cover
will result in a rear yard setback of 11 feet. The code
requires a rear yard setback of 25 feet for this lot.
Staff believes the variance request to be reasonable.
Cypress Point Addition is a new subdivision built on Cypress
Point Lake. The applicant's home backs up to the lake.
Between the lake itself and the applicant's property is a
common area or green space. The nearest home to the rear is

over 300 feet across the lake. Allowing the rear yard
encroachment will have no impact on properties to the rear.
As was stated earlier, the applicants' home is the only one
on Cypress Cove. All other lots are vacant and, as of this
writing, no homes were under construction. Allowing the
variance will not impact the other properties on the street.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to the covered patio not being enclosed on
any side other than at the point it adjoins the house.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to the covered patio not being enclosed on any side other than at
the point it adjoins the house. The applicant offered no
additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes, 0 absent and
1 open position.
