A. Public Works Issues:
1. Stormwater detention ordinance applies to this property.
2. Repair or replace any curb and gutter or sidewalk that is
damaged in the public right-of-way prior to occupancy.
B. Staff Analysis•
Royal Overhead Door Company occupies a 10,000 square foot
building located on the I-2 zoned property at 10625 Otter
Creek East Blvd. The existing building has a side yard
setback on the north side of 10 feet. The applicant
proposes to construct an 81000 square foot addition onto the
rear of the building, maintaining the existing 10 foot side
yard setback. The code requires a minimum side yard setback
of 15 feet in the I-2 district.
Staff believes the variance request to be reasonable. The
existing building was constructed in 1975. At that time,

the Zoning Ordinance required no side yard setback in the
industrial district except where the site abutted
residential property. The Code changed in 1980, and the 15
foot side yard requirement was implemented at that time.
The large property adjacent to the north is also zoned I-2
and is occupied by a tractor and heavy equipment sales and
service company. The portion of the property adjacent to
Royal Overhead Door is used as an open storage yard for the
equipment. Allowing the reduced side yard setback for Royal
Overhead Door should have no impact on the adjacent
property.
The project has already been through building permit review
with appropriate response from Building Codes, Public Works
and others. A landscape plan has been approved.
C. Staff Recommendation:
Staff recommends approval of the requested side yard setback
variance subject to compliance with the following
conditions:
1. Compliance with the City's Landscape and Buffer
Ordinances
2. Compliance with Public Works Comments

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with Public Works Comments and with the City's
Landscape and Buffer Ordinances.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes, 0 absent and
1 open position.
