Variance Requested: A variance is requested from the
home occupation provisions of
Section 36-253 to permit a home
occupation conducted in an
accessory structure.
Justification: Applicant's Statement: I have an
operation in an accessory building
on my property. The operation
involves computers communicating
with one another. I do not see
customers. There is no walk in
business. I have no employees
other than myself. There are no
signs. There are no deliveries. I
have no company vehicles as such.
The building is kept in good
repair. There is no noise,
excessive lighting, etc.
The computers are on-line 24 hours
7 days a week but do not require an
operator at all hours.
I courteously and respectfully
request a variance from the City
Ordinance that would permit me to
continue operation of my business
in its present location in the
manner described above.

Staff Report:
A. Public Works Issues:
No issues.
B. Staff Analvsis:
The R-2 zoned property located at 2407 N. Grant Street is
occupied by a one-story, brick and frame, single-family
residence. A 14 feet by 24 feet, accessory building is
located in the rear yard of the property. The applicant has
for 20 years operated a business in the accessory building.
He recently was advised that he needed to obtain a home
occupation accessory use permit to operate the business.
Section 36-253(b)(6)(5) of the code prohibits home
occupations which involve accessory buildings.
The applicant is the sole employee of the business which
conducts loss control for rental stores such as video,
formal wear and furniture rental. The business maintains a
database and provides information to these rental stores.
The business involves the use of a computer, fax machine and
telephone. No customers come to the site no deliveries are
made to the site and there are no company vehicles as such.
There is no signage identifying the business. In all
aspects, save one, the business conforms to the home
occupation guidelines.
Staff believes it is appropriate to allow the applicant to
continue to operate his business from the accessory
structure. It does not appear that the use of the structure
has had a negative impact on the neighborhood, if it has
been used for 20 years. It is also appropriate to condition
the approval on the applicant's continued use only and in
the manner described by him.
C. Staff Recommendation:
Staff recommends approval of the variance to allow use of
the accessory building for a home occupation subject to
compliance with the following condition:
1. The approval is granted only for the applicant,
Darrell Ross, as long as he occupies the residence at

2407 N. Grant Street and continues to operate the
business in the manner described in this application.
2. Compliance with the Home Occupation Accessory use permit
regulations established in Section 36-253.
BOARD OF ADJUSTMENT:

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the conditions outlined above.
The applicant offered no additional comments. The item was
placed on the Consent Agenda and approved as recommended by
staff. The vote was 4 ayes, 0 noes and 1 absent.
