Public Works Issues: Z-6625 Dr. Archie Hearne Northeast corner of East 10th and Rock Streets Lots 4, 5 and 6, Block 59, Original City HDR Variances are requested from the bulk and area provisions of Section 36-418 to permit construction of townhouses with reduced setbacks. The front of the buildings are proposed to align along the street with the existing structures in the immediate vicinity. Vacant lots Townhouses, 12 units 1. A 20, radial dedication of right-of-way is required at the corner of Rock and East 10th Street. 2. Property frontage needs to have the sidewalks and ramps brought up to the current ADA standards. 3. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-of-way prior to occupancy. 4. Improve alley and pave to 18' feet wide. S. Provide design of street " MSP" (Master Street Plan). Construct one-half street improvements or request waiver. February 22, 1999 Item No.: 4 (Cont.) 6. Plans of all work in right-of-way shall be submitted for approval prior to start of work. 7. Stormwater detention ordinance applies to this property. 8. Driveways shall conform to Sec. 31-210 or Ordinance 16,577. B. Staff Analysis: The applicant proposes the construction of a two building, 12 unit townhouse development on the HDR zoned property located at the northeast corner of East 10`h and Rock Streets. The applicant proposes 8 townhouse units in the structure facing Rock Street and 4 townhouse units in the structure facing East 10th Street. Each townhouse will be two stories in height and will have two bedrooms. Parking is accessed from an alley on the east side of the development. The required setbacks are determined by designating the Rock Street perimeter as the front. The applicant proposes a front yard setback of 9 feet, a rear yard setback of 5 feet, an exterior side yard setback of 9 feet and an interior side yard setback of 5 feet. The HDR district requires front yards of 25 feet, rear yards of 20 feet, exterior sides of 10 feet and interior sides of 5 feet. Shared steps will extend from the structures toward the sidewalks. Staff believes the requested setback variances are appropriate and reasonable. The buildings are designed and located on the lots so as to be compatible with existing development in this older, historic neighborhood. Most structures in this area are located closer to the street and the applicant's development lines up with other structures on the street. A 20 foot wide alley right-of-way is located behind the development and an older apartment building is located on the property beyond the alley. Allowing the reduced setbacks is compatible with development in the neighborhood and should not have a negative impact on adjacent properties. The Little Rock Historic District Commission approved a Certificate of Appropriateness for this development at its October 1, 1998 meeting. Staff applauds this important infill development and notes only one item of concern. The landscape strip on the north side of the parking lot falls below the minimum required by 2 February 22, 1999 Item No.: 4 (Cont.) the landscape ordinance. This must be remedied or a variance must be obtained from the City Beautiful Commission. C. Staff Recommendation: Staff recommends approval of the requested setback variances subject to compliance with the following conditions: 1. Compliance with the City's Landscape and Buffer Ordinances 2. Compliance with conditions imposed by the Historic District Commission 3. Compliance with Public Works Comments BOARD OF ADJUSTMENT: (FEBRUARY 22, 1999) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the conditions outlined above. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 3 ayes, 0 noes, 1 absent and 1 open position. 3
