The fence is needed to provide security and privacy. The top 2 feet of the 8 foot fence will be lattice, not solid wood. Single Family Single Family A. Public Works Issues: No issues. B. Staff Analysis: The R-2 zoned property located at 4816 " I" Street is occupied by a one-story, single-family residence. A portion of the rear yard is enclosed by a 4 foot tall, chain link fence. The applicant proposes to replace this fence with a new 8 foot tall, wood, privacy fence. Section 36-516 of the code limits the height of fences in residential zones to 6 feet. Staff believes the variance request to be reasonable. Although the new fence will be 8 feet in height, the top 2 feet of the structure will be lattice, not solid wood. The February 22, 1999 ' Item No.: 3 (Cont.) new fence encloses only a portion of the rear yard, well away from "I" Street and the side street, Monroe. Only a small portion of the fence is on the common property line between the applicant's property and the property adjacent to the north. Staff does not believe the proposed fence will have a negative impact on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested fence height variance to allow an 8 foot tall, wood privacy fence subject to compliance with the following conditions: 1. The top 2 feet of the 8 foot tall fence are to be lattice. 2. The fence is to be built with the finished side facing outward. BOARD OF ADJUSTMENT: (FEBRUARY 22, 1999) The applicant was present. There were no objectors present. Staff presented the item and informed the Board that the applicant had requested that he be allowed to construct portions of the fence to be 8 feet tall without the top 2 feet being lattice. Staff stated that the only reason the lattice was made part of the recommendation was that it matched the applicant's proposal. Staff stated that allowing the fence to be solid wood up to a height of 8 feet should have no impact on adjacent properties, due to the placement of the fence. Staff recommended approval of the fence height variance to allow an 8 foot tall wood privacy fence subject to the fence being built with the finished side facing outward. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 3 ayes, 0 noes, 1 absent and 1 open position. 2
