3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH ESCAMILLA EXCAVATING, LLC, IN AN
5 AMOUNT NOT TO EXCEED THREE HUNDRED ONE THOUSAND,
6 EIGHT HUNDRED TWENTY THREE DOLLARS AND 10/100
7 ($301,823.10), FOR THE ZION STREET EXTENSION PROJECT, FROM
8 37TH STREET TO 38TH STREET; AND FOR OTHER PURPOSES

10 WHEREAS, Resolution No. 15,524 (August 17, 2021), as adopted by the Little Rock Board of
11 Directors,expressed the intent to allocate Two Hundred Forty Thousand Dollars($240,000.00)in American
12 Rescue Act Funds for Water and Sewer Infrastructure to support future affordable housing sites;and,
13 ! WHEREAS,Resolution No. 15,676(May 3, 2022),as adopted by the Little Rock Board of Directors,
14 expressed the intent to prioritize expenditures for Water and Sewer Infrastructure and allocate Seven
15 Hundred Ten Thousand Dollars($710,000.00)in American Rescue Act Funds to support future affordable
16 housing sites; and,
17 WHEREAS, Bid 2233 was issued for the Zion Street Extension Project, 37th Street to 38th Street;and,
18 WHEREAS, Escamilla Excavating, LLC, submitted the lowest responsive, responsible bid meeting
19 specifications of five(5)bidders.
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The City Manager is hereby authorized to execute an agreement with Escamilla Excavating,
23 LLC, for the Zion Street Extension Project, 37th Street to 38th Street, in an amount not to exceed Three
24 Hundred One Thousand,Eight Hundred Twenty-Three Dollars and 10/100($301,823.10),which is the base
25 bid amount of Two Hundred Fifty-One Thousand, Five Hundred Nineteen Dollars and 25/100
26 ($251,519.25), plus 20% contingencies.
27 Section 2. Funding for this project is from the State and Local Fiscal Recovery Fund Grant authorized
28 by the American Rescue Plan Act, as approved by Resolution No. 15,524,Account No. G0215AR35B.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
33 resolution.

1 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
2 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
