A variance is requested from the
height regulations of Section
36-301 to permit construction of a
hotel exceeding 35 feet in height.
This is the proto-typical "Ramada"
that is being built around the
country. The pitched roof is more
aesthetically pleasing than a flat -
roofed structure.

Comments from previous, January 25, 1999 Board of Adjustment
approval:
1. Property frontage for all three bounding streets needs to
have the sidewalks and ramps brought up to the current
ADA standards.
2. Repair or replace any curb and gutter or sidewalk that is
damaged in the public right-of-way prior to occupancy.
3. Plans of all work in right-of-way shall be submitted for
approval prior to start of work.
4. Stormwater detention ordinance applies to this property
with planned development.
5. Replat as single lot required or waiver of service
easement requirements needed prior to building permit.

6. Dedicate right-of-way on Shackleford Road to place
sidewalk completely in Public Street right-of-way.
Dedication shall be to face of retaining wall.
B. Staff Analysis:
On January 25, 1999, the Board approved a parking variance
to allow for construction of a three-story, 60 room hotel on
this site. The proposed development, combining Lots 1R and
7, will consist of the proposed hotel and an existing
restaurant. The variance allows for the project to have a
total of 123 parking spaces, 2 less than the 125 required by
the Ordinance. At that time, the applicant thought the
proposed hotel would not exceed the district height limit.
He has since discovered that the architectural design
acceptable to Ramada Inn has a pitched roof and a building
height of 38± feet. The applicant is requesting a height
variance of 40 feet, to assure that all height issues will
be addressed.
Staff is supportive of the requested 5 foot height variance.
The minor variance should not be visually noticeable to the
naked eye. The main body of the hotel is just over 28 feet
in height. The structure has a pitched roof which causes
the height to exceed the ordinance maximum. The structure
proposed by the applicant is architecturally appealing; with
a dryvit exterior, ornamental metal balconies and a pitched,
asphalt -shingled roof. Allowing the height variance should
have no impact on adjacent properties.
C. Staff Recommendation:
Staff recommends approval of the requested height variance
subject to compliance with the following conditions:
1. Lots 1R and 7, containing the existing restaurant and
proposed hotel, are to be replatted as a single lot.
2. Compliance with Public Works Comments
3. Compliance with the City's Landscape and Buffer
Ordinances. (NOTE: The perimeter and interior
landscaping shown on the site plan submitted for the
hotel site appear to fall below ordinance minimums. A
revised site plan must be submitted which conforms to
ordinance standards.)

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the conditions outlined above. Staff informed
the Board that the required replat had been completed.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes and 1 absent.
