Justification: Applicant's Statement: We would like to remove a small sub -standard addition constructed by a previous owner and be able to continue the line of the existing roof. Present Use of Property: Proposed Use of Provert : Staff Report: A. Public Works Issues: No issues. To do so we are requesting a variance from Section 36-156 as the brick residence would be located 3'-6" from a single -car wood frame garage. This is the best solution for the structural integrity and from a design standpoint. If necessary we are receptive to having a plain wall with no windows where the residence is closest to the garage. The lot size is 50' X 140' and the existing residence is 1,472 square feet. The residence sits approximately 60' from the rear property line. The west side of the residence is 4.6' from the property line. Single Family Single Family December 21,.1998 Item No.: 9 Cont_ B. Staff Analysis: The R-2 zoned property located at 5108 Stonewall Road is occupied by a small, one-story, brick and frame, single- family residence. Several years ago, a substandard, flat roof addition was constructed onto the rear of the house. The applicant proposes to substantially remodel the house, including the removal of the flat roof addition and, in its place, extend the entire house an additional 14 feet to the rear. The new addition will maintain the existing side yard setback of 4.6 feet and will be separated from a detached garage structure by 3.5 feet. The Code requires a side yard setback of 5 feet for this lot and requires accessory structures to have a minimum separation from the principal structure of at least 6 feet. Staff believes the variance requests to be reasonable. Allowing the addition to maintain the existing 4.6 feet side yard setback should not impact the adjacent property. This minor variance is within the 10 percent that staff can approve. The separation requirement between structures is primarily a fire department issue. The Fire Marshall inspected the site and approved the proposal subject to there being no openings, doors or windows, on the east side of the addition (the side adjacent to the accessory structure). The separation variance will not impact adjacent properties. The proposed addition should result in a more aesthetically pleasing and structurally sound residence. C. Staff Recommendation: Staff recommends approval and separation variances doors or windows, on the closest to the accessory BOARD OF ADJUSTMENT: of the requested side yard setback subject to there being no openings, east side of the addition (the side structure). (DECEMBER 21, 1998) Sallie Overbey, architect, was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval subject to there being no openings, doors or windows, on the east side of the addition. Staff informed the Board that, of the 17 people notified of the hearing by the applicant, 5 were notified 3 days later than specified by the Board's bylaws. Staff noted that there had been no contact from anyone opposed to the issue. A motion was made to waive the Bylaws and to accept the notification as presented. The motion was approved by a vote of 3 ayes, 1 noe, 0 absent and 1 open position. The applicant offered no additional comments. 2 December 21, 1998 Item No.: 9 (Cont.) The variance request was placed on the Consent Agenda and approved as recommended by staff. The vote was 4 ayes, 0 noes, 0 absent and 1 open position. 3
