Justification: A lican.t's Statement: I propose to construct a bedroom and studio addition to the back of my existing residence. It is my understanding that a minimum setback dimension of twenty-five feet, from the back property line to the structure, is required at the back of the property. We request a zoning variance for the following reasons: 1. The proposed construction will be a minor infringement on the zoning setback. The infringement is a varying width of one foot (1'-0") to four feet four inches (4'-411). 2. Without a variance, the internal structural configuration of the proposed studio will be too narrow and too small to be usable. Staff Anal sis The R-2 zoned property located at 8418 Leawood Blvd. is occupied by a split-level, brick and frame, single family residence. The applicant proposes to remodel the home including the addition of a new bedroom, bath, studio and deck onto the rear of the residence. The new addition will result in a rear yard setback of 20 feet 9 inches. The Code requires a rear yard setback of 25 feet for this lot. Staff believes the variance request to be reasonable. Due to the angle of the rear property line, the variance involves only a corner of the proposed addition. The infringement varies from 1 foot to just over 4 feet and is not much beyond what staff has authority to approve. The property is located at the end of a rectangular block and no homes back directly to this home. The proposed variance should have no impact on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD OF ADJUSTMENT: (DECEMBER 21, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved by a vote of 4 ayes, 0 noes, 0 absent and 1 open position. 2
