Myssbridgette Ann Greene Address: 7109 Eddy Lane Description: Lot 14, Block 21, Fairfield Cove Addition Zoned• R-2 variance Requested: Variances are requested from the area and separation requirements of Section 36-254 and the building line provisions of Section 31-12 to permit placement of a detached carport with reduced setbacks and which crosses a platted building line. Justification: Applicant's Statement: It was very recently brought to my attention that I am in violation due to having a car cover built on my property at the above stated address. Let me first state that this violation was completely unintentional, had I any idea I would have followed all policies and procedures in order to have it done by your standards. I am a 23 year old single parent and this is my first home. The use of the car cover is to protect my two small children from the harsh elements of winter and rain as well as enhance the life of my car. Therefore, it is my hope that you will grant my request for this variance that I so desperately need. It will be good for my children, the youngest being asthmatic. I appreciate your consideration on this matter and should you have any further questions, please contact me promptly. Present Use of Pro ert : Single Family Proposed Use of Property: Single Family November 30, 1998 No.: 5 (Con Staff Report: A. Public works Issues: No issues. B. Staff Analysis: This issue is before the Board as a result of action by the City's Code Enforcement staff. The R-2 zoned property at 7109 Eddy Lane is occupied by a one story, brick and frame, single-family residence. The applicant has recently placed a 12 foot by 20 foot, detached, aluminum carport in front of the house. The carport has a front yard setback of 5 feet and is directly adjacent to the house. The Code requires accessory structures to have a minimum front yard setback of 60 feet and a minimum separation from the house of 6 feet. The carport is also located across a platted 25 foot, building line. The applicant just recently purchased the property and placed the carport without knowledge that it violated city code. She was issued a notice by the Codes Enforcement staff and subsequently filed for relief from the Board of Adjustment. Staff believes the variance requests to be reasonable. The carport occupies approximately 20 percent of the required front yard, leaving adequate open space. The carport is open and unenclosed on all sides. The carport has a setback of 16 feet from the curb of Eddy Lane which allows adequate sight distance. Eddy Lane is a level, minor residential street which serves a limited number of homes. The street is a dead-end with limited vehicle traffic. Placement of the carport should not impact traffic on the street. The 6 foot separation requirement is primarily a fire safety issue. The carport is constructed entirely of metal and is open on all sides to allow clear access to the home. Should the Board approve the building line variance, the applicant will have to do a one -lot replat reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk's Office to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested setback, separation and building line variances subject to the following conditions: 2 November 30, 1998 Item No.: 5(Cont.) 1. A one lot replat reflecting the change in the building line as approved by the Board. 2. The carport is to remain open and unenclosed on all sides. BOARD OF ADJUSTMENT: (NOVEMBER 30, 1998) The applicant was present. There were no objectors present. Several letters of support from neighborhood residents had been received by staff and forwarded to the Board. Staff presented the item and a recommendation of approval subject to compliance with the following conditions: 1. A one lot replat reflecting the change in the building line as approved by the Board. 2. The carport is to remain open and unenclosed on all sides. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 4 ayes, 0 noes, 0 absent and 1 open position.
