To amend an existing conditional
use permit to allow for the
conversion of a 14.2 foot by 20.1
foot building into an additional
accessory dwelling on R-2 zoned
property at 8902 Johnson Lane.
This site is on the north side of Johnson Lane, which
branches off of the east end of Johnson Road, and the site
is about 0.3 mile east of Heinke Road.
2. CoMpatibility Compatibilitywith Neighborhood:
The property is zoned R-2, Single Family Residential, and the
entire four tract area is still under one ownership and being
considered as one Tract for this action. The property north
of this site is zoned R-2 and is vacant and wooded. The
property immediately east of this site is also mostly vacant
and wooded and is zoned OS. There is a multisectional
manufactured home located immediately west of this site with
a large concrete block shop building, a duplex is located to
the south, and an auto shop to the southeast. There are
several other single family residences in this general area.
These consist of a mixture of stick built and various sizes
of manufactured homes.
Staff believes that enclosing and remodeling this existing
structure for an accessory dwelling would be compatible with
the surrounding area.
The Rolling Pines Neighborhood Association and Norman Floyd
were notified of the public hearing. A letter of support has
been received from both.
3. On -Site Drives and Parkin :
This new dwelling will be accessed by a single driveway from
Johnson Lane which will provide access and a required
parking space.

5. Public Works Comments:
Dedicate right-of-way to 60 feet from centerline for the
South Loop Road.
6. utility and Fire Department Comments:
Water: No objection.
Wastewater: Sewer main extension required with easements to
provide service.
Southwestern Bell: Approved as submitted.
ARKLA: No Comments received.
Entergy: Approved as submitted.
Fire Department: Approved as submitted.
LATA: This site is near LATA Route #17 (Mabelvale-
Downtown).
7. Staff Analysis:
The applicant is requesting to amend an existing conditional
use permit to allow for remodeling and enclosing an existing
structure to make it into a single story accessory dwelling.
In August of 1996, a conditional use permit was approved for
this site to place a single -wide manufactured home as an
accessory dwelling for the main house which lies to the east
of this structure. The mother lives in the single -wide and
the house has been rented out. Bobbie Jones the son, has
been living with his mother in the manufactured home and
desires to have his own place to live. Enclosing and
remodeling an existing pavilion structure was chosen as the
cheapest and quickest method to accomplish this.
This is a large tract of land on the end of Johnson Lane.
Modifying this existing structure will not change the
overall footprint of structures on the property by very much
and will not cause crowding on the site. All setbacks are
exceeded for this structure.
Staff believes the proposed use would be compatible with the
neighborhood.

The proposed South Loop Road passes through what is labeled
as Tract C on the site plan. Public Works has requested
that the required right-of-way for this road be dedicated
prior to issuing any building permit. The applicant has
requested a deferral of this dedication with no stated time
limit on the deferral. Public Works does not support the
deferral.
8. Staff Recommendation:
Staff recommends approval of the conditional use permit
subject to the following conditions:
1. Comply with Public Works Comment and dedicate right-of-
way for South Loop prior to issuance of a building
permit.
2. Any sale of any of the tracts of this property or further
construction/development on this property will
necessitate final platting of the entire property and
street dedication and improvements to Johnson Lane.
SUBDIVISION COMMITTEE COMMENT: (NOVEMBER 5, 1998)
Bobby Jones was present representing his application. Staff gave
a brief description of the proposal.
Public Works Comments and the question of platting were
discussed. It was determined that since the only thing being
done now is to enclose and remodel an existing pavilion
structure, that Johnson Lane upgrades and platting of the
property was not necessary at this time. It was made clear
to the applicant that any sale of tracts or further
construction/development would require those actions to take
place.
There being no further issues, the Committee accepted the
proposal and forwarded the item to the full Commission for final
resolution.
PLANNING COMMISSION ACTION: (DECEMBER 3, 1998)
Bobby Jones was present representing his application. Staff
presented the item with a recommendation for approval subject to
conditions listed under "Staff Recommendation."
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 7 ayes, 0 nays and 4 absent.
